Photo: Privat The background for the appeal is that they believe the court has made a mistake regarding the burden of proof rules and the evidence regarding the civil claims, Kjensli elaborates to news. – In my opinion, they have based an overly lenient evaluation of the evidence and we believe that there are grounds for appealing this, says lawyer Morten Kjensli. Kevin Simensen’s legal aid lawyers filed a claim in court for compensation for the damages he suffered. They believed the defendant should be sentenced to pay reparation compensation of NOK 80,000 to Simensen. They also asked that he be sentenced to pay 26,000 in compensation to Simensen for expenses incurred. For Kristian Pablo Teigen, who was hit twice in the thigh with a baton, the legal aid lawyers asked for restitution compensation of NOK 50,000. – Is it the compensation claim you are not satisfied with? – Yes, there are several things we are not happy with about that decision. But we have nothing to do with that. It is up to the prosecuting authority at the Bureau and the Attorney General to decide questions about the judgment as regards the assessment of guilt. Kjensli says they are not dependent on the prosecution also appealing. – We have a completely independent right of appeal in accordance with the civil requirements and we have an appeal deadline of one month. The district court found that our client had acted lawfully and cannot be claimed for compensation. – It is in accordance with our view. Such a civil appeal must be screened by the Court of Appeal, and special reasons are required to allow it in, says Elden.
