Market Fragmentation and the Rise of Unauthorized Downloads

Market fragmentation, increasing subscription prices, and an  unfriendly user experience  are the  main factors  driving a renewed interest in unauthorized downloads. Since Netflix began raising rates and banning shared accounts, customers have raised the threat of resorting to downloading once again. Now, for the first time in years, the numbers seem to corroborate their concerns.

The emergence of  streaming services  initially curbed unauthorized downloads. With the promise of a wide and accessible catalog for a fixed rate, platforms such as Netflix significantly reduced the consumption of movies and series outside conventional channels. However, the  utopia  of a completely legal market run by corporations has faded over time. Recent reports indicate a sharp rise in access to unauthorized content, reversing the trend of the previous decade.

According to the Observatory of Piracy and Consumer Habits of Digital Content 2024,  digital piracy in Spain  surged by 9% last year, reaching a staggering  €42.782 billion  in defrauded content through  7.33 billion illegal accesses . For the first time, the study recorded access to streaming platforms through apps, social media, and decoders, increasing the aggregate figure by an additional  14%  compared to the previous year.

Why This Trend?

The resurgence of unauthorized downloads is attributable to several evolving factors:

Loss of Convenience in Streaming

One of the key reasons for the public’s disenchantment with streaming is that the  offer  has become increasingly dispersed. To access all relevant content, users must subscribe to numerous services. The  exclusivity strategy  employed by studios to attract and retain subscribers has shattered the convenience of accessing content legally. To watch a series with multiple seasons, the user often has to juggle different subscriptions or wait months for certain shows to change platforms. This chaotic dynamic clashes head-on with the immediacy that consumers expect from digital content.

Challenges in Streaming Services

This fragmentation is exacerbated by a licensing war, as each studio seeks to retain their titles exclusively on their respective platforms. This leads to situations where users must subscribe to specific services just to gain access to popular franchises like  Marvel ,  Star Wars , or even  Stranger Things .

Decreasing Quality of Service

In addition to rising prices and fragmentation, the quality of service provided by some platforms has also declined, further hindering user loyalty. Many services have lowered the  bitrate  of their streams to cut costs, resulting in poorer image quality. This deterioration often prompts users to search for illegal versions that offer superior viewing experiences. It is paradoxical: an unauthorized copy of a film can often provide better visual and audio quality than the one available through legal streaming platforms.

Evolution of Unauthorized Downloads

Moreover, unauthorized downloads have adapted. Traditional torrent downloads are supplemented by  streaming  through unofficial platforms, unauthorized  IPTV services , and content distribution via social networks like  Telegram  and  WhatsApp . In 2023, a staggering  96%  of movie and series consumption occurred through unauthorized streaming, highlighting a landscape where users no longer even need to download files, significantly reducing their risk.

In 2011, Gabe Newell noted that “Piracy is not a price problem, it is a service problem.” In the face of a legal market that has become expensive, fragmented, and inconvenient, users view unauthorized downloads as an alternative “service” that provides all content with better quality and at no cost. This predicament can be partially traced back to industry practices that have inadvertently created such conditions.

As these trends evolve, it becomes imperative for industry leaders to rethink their strategies. A focus on  enhancing user experience , streamlining access to content, and maintaining competitive pricing may prove crucial in curbing unauthorized downloads. Addressing these concerns not only influences industry profitability but also impacts how consumers engage with digital media in the long run.
