The Agronitrogenados Case: Background and Current Status
Alonso Ancira, majority shareholder of Altos Hornos de México, is at the center of ongoing legal disputes related to a significant fraud case involving the Agronitrogenados fertilizer plant purchased by Petróleos Mexicanos (PEMEX). As confirmed by the Attorney General’s Office (FGR), Ancira still owes a total of 216 million dollars as part of this case.
Pending Payments and Legal Consequences
During a recent conference, President Claudia Sheinbaum stated that Attorney General Ernestina Godoy Ramos confirmed the outstanding payment issue, indicating that the final installment was due in December 2023. If Ancira fails to make the payment, the FGR has stated that they will resume criminal proceedings against him.
Historical Context of the Settlement
The legal troubles stem from an earlier decision in which Lozoya, former head of Pemex, allegedly authorized the inflated purchase of the Agronitrogenados plant. The FGR has determined that Pemex paid 275 million dollars for the plant, while an independent valuation suggested it was worth merely 58 million dollars. This discrepancy led to a reported fraud of 216 million dollars.
The Payment Agreement
In 2021, a reparation agreement was established at Ancira’s request, requiring him to cover the fraud amount through three payments. The Board of Directors of Pemex authorized this arrangement, and the first two payments—50 million dollars and 54 million dollars—were made on schedule by November 2022.
However, the third payment, amounting to 112 million dollars, was scheduled for November 30, 2023, and remains unpaid.
Extensions and Legal Complications
After the missed payment, the FGR requested to resume the criminal process against Ancira in December 2023. Ancira sought an extension due to financial restructuring efforts, leading to a new deadline of November 30, 2024. However, the approval of this extension was complicated by ongoing legal challenges from Emilio Lozoya, whose appeals have created a blockade in the continuation of proceedings against both him and Ancira.
Current Legal Standing
The situation remains precarious for both Ancira and Lozoya. The FGR indicated that there are still unresolved appeals in a collegiate court, which prevents the prosecution of the former businessman and official for the time being. With legal proceedings and negotiations continuing, the outcome of this case remains uncertain, underlining the complexities involved in high-stakes corporate fraud in Mexico.
