The Unique Case of a Homeless Inheritance Refusal
In Belgium, a fascinating phenomenon has emerged regarding inheritance rights. As of January 1, 2025, nearly 26,000 individuals have voluntarily renounced their shares of inheritance, according to the Federation of Notaries (Fednot). Amidst this trend, one particular case stands out: a homeless man who has chosen to refuse a substantial inheritance of over 43,000 euros for more than a year, despite having his rights legally acknowledged.
Discovery of Inheritance
The incident unfolded in July 2023, when emergency services found the man unconscious on the streets of Brussels. Upon examination, they discovered 43,000 euros in cash tucked into his waistband. This discovery led the authorities to seize the money while they investigated its origins.
According to the man’s lawyer, this money constitutes his share of a family inheritance. He had previously withdrawn the sum from a bank due to mistrust in the financial system, opting instead to live a marginal existence reliant on organizations that assist homeless individuals.
Judicial Confirmation
After extensive judicial procedures lasting over a year, Belgian courts confirmed the legitimate origin of the money and approved its return. The funds were transferred to a bank account controlled by the family lawyer, who is now waiting for the homeless man to collect his due.
However, the issue remains that the man continuously avoids collecting his inheritance. “Whenever I manage to contact him, he assures me he will come the next day, but he never shows up,” his lawyer lamented. Consequently, since 2024, the money has been effectively locked until the man makes a formal acceptance or resignation.

Broader Trends in Inheritance Renunciation
This unique case is indicative of a broader trend, as Fednot reports that over 26,000 individuals filed free resignation requests before notaries in the first half of 2025. In comparison, the previous year saw 58,459 cases, a marked increase from 39,794 in 2019.
If an heir fails to act, the state assumes acceptance of the inheritance, obligating them to settle any outstanding debts of the deceased and file the necessary inheritance tax return. To mitigate this potential liability, heirs are incentivized to officially renounce their claims.
While the legal perspective on this case appears closed, the emotional implications for the homeless man remain unresolved. Despite the availability of his inheritance, he continues to resist the notion of accepting it.
Reasons for Renouncing Inheritance
Several factors contribute to the decision to reject an inheritance:
- Debts connected to the assets, potentially forcing the heir to take on financial responsibilities.
- Desire for freedom from familial ties or responsibilities tied to costly properties.
- Legal strategies employed where parents transfer inheritance rights to their children.
The complexity of managing an inheritance can often be overwhelming, with costs involved in maintaining or transferring assets pushing individuals towards renunciation.
