Recent Modifications to Police Force Regulations in Peru

The Peruvian Executive has enacted significant changes to the Regulations of Legislative Decree No. 1186, governing the use of force by the National Police of Peru (PNP). Officially documented in Supreme Decree No. 021-2025-IN, this update addresses the regulatory framework, ensuring it aligns with recent modifications brought about by Law No. 32291.

Key Changes to Law Articles

Introduction of Article 11-A

One of the pivotal updates is the introduction of Article 11-A, which specifically pertains to self-defense scenarios during acts of flagrancy. This regulation allows police officers to utilize lethal force against aggressors who pose an imminent risk through the use of firearms or other dangerous implements, even if these are mimicked or inoperative.

Modifications to Existing Articles

Articles 6, 8, and 9 of the pre-existing regulations have also been amended:

  • Article 6 now emphasizes the principles of legality, necessity, and proportionality, mandating that any use of force by police aligns strictly with established legal standards and protocols.

  • Article 8 defines forms of resistance citizens may exhibit in response to police action, distinguishing between passive and active resistance. This section elaborates on various manifestations of behavior, indicating how police should respond in differing situations.

  • Article 9 reaffirms that the levels of force applied must correspond proportionately to the degree of resistance encountered. This ensures a structured approach to police action, specifying preventative and reactive measures.

Emphasis on Lethal Force Regulations

A critical aspect of this reform is the meticulous delineation of when lethal force can be deployed. The updated regulations stipulate that the use of firearms is justified solely in scenarios of genuine and immediate danger concerning death or severe injury, aimed at protecting the lives of officers or innocent bystanders.

Compliance with International Standards

The updates mandate that all police actions must adhere to operational guidelines and international human rights commitments. This requirement enhances the transparency of police practices and fosters accountability within the force.

Conclusion: A Step Towards Regulating Police Conduct

These modifications intend to bolster the integrity of the PNP, ensuring that operations remain lawful and justifiable amidst evolving societal challenges. The government’s focus on adapting the regulations reflects a growing recognition of the need for clear guidelines that safeguard both public safety and the rights of citizens under police action.
