Supreme Court of Brazil Orders Home Arrest of Jair Bolsonaro

In a significant legal development, the  Supreme Court of Brazil  has ruled on Monday that former President  Jair Bolsonaro  (2019-2023) will serve his sentence under  house arrest . This decision comes in light of his  alleged breaches  of several precautionary measures linked to his suspected involvement in a plot aimed at undermining legal proceedings against him, including accusations of attempting a coup d’état.

“Given the repeated breach of the previously imposed precautionary measures, I order the house arrest of Jair Messias Bolsonaro,” announced  Supreme Justice Alexandre de Moraes , the presiding judge of the case. These remarks were reported by the Brazilian news portal  UOL .

As part of the court’s order, Brazilian authorities have initiated a  registration and seizure operation  at Bolsonaro’s residence in Brasília. Under the terms of his house arrest, he is prohibited from receiving visitors, except for his legal team, and is banned from using mobile phones, including devices belonging to others. He is also required to wear an  electronic anklet  to monitor his movements.

The judge’s ruling followed Bolsonaro’s alleged use of social media accounts belonging to his eldest son, Flávio, on the eve of  demonstrations  that were staged in the former president’s support. These actions were interpreted by the court as attempts to pressure the Brazilian authorities and disrupt ongoing legal proceedings.

Bolsonaro’s defense team has expressed shock at the ruling, asserting that the former president has not violated any court-imposed measures. They defended his actions by stating, “The phrase ‘Good afternoon, Copacabana. Good afternoon, my Brazil. A hug to all. It is for our freedom. We are together’ cannot be understood as a breach of precautionary measures, or as a criminal act.” They have announced plans to  appeal the decision .

In a separate but related incident, the  United States Department of State  has criticized Judge Moraes for what they view as an abuse of judicial power. They stated, “The judge, now sanctioned by the United States for human rights violations, continues to use Brazilian institutions to silence the opposition and threaten  democracy .”

The statement from Washington condemned the imposition of house arrest on Bolsonaro, arguing that it serves to further constrict his ability to defend himself publicly. “Let Bolsonaro speak,” the U.S. remarked, advocating for transparency in the ongoing legal battles.

This development follows ongoing investigations by Brazilian law enforcement. Back in mid-July, authorities conducted raids at Bolsonaro’s residence, examining his alleged role in financing efforts in the United States to advocate for  tariffs and sanctions  against Brazilian officials, including Supreme Court judges, whose visas were reportedly revoked by Washington.

Investigators claim that Bolsonaro funneled around  two million reais  (approximately  $300,000  or  €300,000 ) to campaign via his son, Eduardo, in the U.S. This was purportedly done to garner support for sanctions at a time when former President  Donald Trump  had shown unusual interest in Bolsonaro’s legal situation.

The Brazilian  Prosecutor’s Office  has recently made its final allegations in the coup trial against Bolsonaro, asking for his conviction. Should he be found guilty, he faces prison sentences of up to  40 years  and could be permanently barred from holding any public office.

Bolsonaro, alongside seven others, is identified as part of the  central core  of a coup plot intended to maintain his power following the October 2022 elections. The group faces multiple serious charges, including  criminal association , attempts to subvert constitutional order, coup d’état, and vandalism during protests against state institutions that occurred on  January 8, 2023 . These legal actions signify a critical juncture in Brazilian politics, as the nation grapples with questions of democracy, accountability, and justice for alleged abuses of power. As the situation evolves, many will be watching closely to see the repercussions of the Supreme Court’s decisions and the subsequent legal battles ahead.
