Andrea Chávez Treviño, a senator from the Morena party, has expressed her unwavering commitment to defending the  rights of children  following the tragic case of  Jasiel Giovanny “N” , a minor brutally murdered in  Chihuahua . In her recent speech, she passionately demanded social justice in light of this heinous crime and urged authorities to transfer the accused perpetrator to a men’s penitentiary, highlighting the urgent need for accountability and fair treatment under the law.

In a formal submission to the Permanent Commission of the Congress, Chávez Treviño not only called for justice for the victim of this  infanticide  but also insisted that state authorities enable the transfer of the accused to a facility commensurate with their  gender identity .

Details of Jasiel’s Case: The eight-year-old child was reported missing on July 2, after going out to play in a park in the  Maniqueo Circuit  subdivision, situated in the southeast of  Chihuahua . Concern escalated when he did not return home, triggering an urgent search effort.

On July 3, the  State Prosecutor’s Office  announced the grim discovery of the child’s body in a nearby field, made during the extensive search operations launched after his disappearance. The case shocked the local community and raised serious questions regarding child safety.

The investigation quickly advanced, resulting in the arrest of the child’s stepfather, identified as Abraham Alejandro “N”, aged 24. Initially charged with  omission of care , he was later implicated in the aggravated and qualified homicide of the child after sufficient evidence was gathered. Currently, the alleged murderer remains incarcerated in a female penitentiary.

Chávez Treviño emphasized that while Abraham Alejandro “N” was assigned a female gender at birth, he has been undergoing a gender transition for several years. Legally and socially recognized as a man, she stated: “In coherence with its decision and identity, it must be transferred to a men’s penalty.”

The senator deemed the control judge’s decision to confine the alleged perpetrator in a female correctional facility as ‘legally inadmissible’. She cautioned that this ruling poses complex and risky implications, especially given the  National Criminal Execution Law , which governs the treatment of incarcerated individuals.

Highlighting the severity of the case, she stated: “The entry of a person linked to the process for crimes as serious as infanticide and violation of a space where children inhabit, even when it is in a context of seclusion, not only contravenes the principle of the best interests of childhood, but can constitute a serious institutional omission.”

Chávez Treviño pointed out that the  homicide  of Jasiel serves as one of the most shocking cases to arise in the region. Allegedly, the  stepfather  took the child from his home and inflicted life-threatening injuries, leading to the child’s untimely death. This tragic incident has underscored the urgent need for legal reform and accountability to ensure that such a tragedy is never repeated.
