The Oslo district court orders Universal Music to remove all posters with a picture of Marius Borg H\u00f8iby, which are hanging in several places around the center of Oslo. This is revealed in a decision from the district court on Monday afternoon. It also states that the image of H\u00f8iby cannot be used in the promotion of the latest album by the artist Marstein. Bj\u00f8rn Rogstad, boss of Universal Music AS, tells news that he has no comment on the case. Nor does the management of Marstein, frkvns, want to make a comment. Photo: Emilie Waaler \/ news The ruling states that H\u00f8iby, as a public figure, must tolerate his images being used in journalistic coverage, but that it is “something quite different” when images are used for a commercial purpose. Furthermore, it is emphasized that the mention of him is derogatory. “His image is also being used in the promotion of a music album that refers to him in a very derogatory way”, writes the court. In this case, the court believes that since it can take a long time to get any lawsuit in place, it will be burdensome if Universal and Marstein do not stop using the image immediately. Universal Music AS is therefore required to stop all use of images of H\u00f8iby in the promotion of Marstein’s music album immediately. – Gross personal offense In a press release from \u00d8yvind Bratlien, H\u00f8iby’s defender, it is stated that the media storm against H\u00f8iby has lasted a long time. – Borg H\u00f8iby was involuntarily made part of a marketing campaign for a music album that refers to himself in very derogatory terms, the press release states. – The personal violation was so gross and the commercial exploitation so clear that we had to deal with it immediately, it continues. Universal Music AS is therefore required to stop all use of images of H\u00f8iby in the promotion of Marstein’s music album. – They must also immediately remove all posters with images of Borg H\u00f8iby associated with this promotion from all physical locations in Norway, writes Bratlien.
