It happened after the parents had asked questions about the kindergarten&#8217;s financial arrangements. The nursery says the dismissal is due to a lack of trust in parental cooperation and is legal, but the parents believe the dismissal is invalid. Now the parents have to realize that their child is not allowed to join in when the friends in the nursery begin Advent and Christmas preparations on 1 December. &#8211; We were completely shocked. But the kindergarten stands its ground, and now the parents have filed a civil lawsuit to keep the place. And the municipality can do nothing but promise a place in another kindergarten. They say that they have not been given any good reasons and are unsure what the nursery school is basing its decision on. &#8211; We are very satisfied with the nursery, and our daughter is enjoying herself. We feel that we have a very good collaboration with the employees, who work with our daughter every day, says Mari Berg\u00e5ker. &#8211; She is developing, she has built new trust in the employees after the summer holidays. She is growing, doing well and talks a lot about the nursery, explains Brage Berg\u00e5ker. If the private daycare does not reverse the decision, they fear that the daughter will have to change daycare. She does not want to be interviewed about the matter, but writes in an SMS: &#8211; Good cooperation between the nursery school and the parents is very important to safeguard the child&#8217;s best interests. If it does not work well, it can affect the child&#8217;s learning outcomes and the psychosocial environment. Furthermore, the chairperson of the kindergarten shows the response to the parents&#8217; lawyer, to whom news has access. There, the kindergarten writes that the parental cooperation over a long period of time has created a poor psychosocial working environment for the employees. The termination is linked to a &#8220;lack of trust over a long period of time&#8221;, and the collaboration should therefore end &#8220;for the good of all parties&#8221;, it says. The letter also refers to &#8220;negative mention of the company and management&#8221;. The answer is signed by the HSE committee in the kindergarten and sent from the chairman&#8217;s e-mail address. They say the questions they have asked are not related to care, but to the framework for staffing and the private nursery owner&#8217;s financial dispositions. &#8211; As parents, we have always had trust in the nursery, so this mistrust only goes one way, says Brage Berg\u00e5ker. &#8211; Have you contributed to a difficult collaborative environment? &#8211; No, on the contrary. We are of the opinion that we are contributors to the kindergarten, he says. &#8211; So, despite this case, do you want your daughter to continue in kindergarten? &#8211; We have always hoped that the nursery will reverse the decision and allow our daughter to continue, because that is in the child&#8217;s best interests, says Brage Berg\u00e5ker. &#8211; Scary and shocking Hege Bae Nyholt from R\u00f8dt heads the education and research committee at the Storting. She herself has a background in the nursery sector. &#8211; In my 17 years in kindergarten, I have never heard of a similar case like this. I think it is simply scary and quite shocking how bad legal protection children in private daycares have, she says. Bae Nyholt believes this could not have happened in a municipal nursery school and points out that the right to appeal there is subject to the Public Administration Act. &#8211; Now we have to make sure that this is included in the Kindergarten Act. It cannot be the case that children in municipal kindergartens have different legal security than children in private kindergartens. This is a problem that has come up now, which we as the highest elected representatives must take on ourselves. &#8211; Very special case Head of education Are Karlsen in Horten municipality believes the case is very special. &#8211; We have been in contact with the state administrator, with KS&#8217; lawyer and the Directorate of Education. They are clear that there is a private law dispute between the nursery school and the parents. So what we can and of course want to do is to ensure that the child gets a nursery place, he says. Karlsen says the municipality has concluded that it does not have the authority to order the nursery to change its decision. &#8211; What do you think about it? &#8211; I will not go into the private law dispute, but I think it is very sad that a child becomes the victim of a conflict between adults. &#8211; Have you come across something similar before? &#8211; No, not at all. And I have not actually found anyone who has come across something similar, neither in the municipality here nor when we have contacted others. This is probably a very special case. The family has also been in contact with the Children&#8217;s Ombudsman, but was told that the Ombudsman does not have the opportunity to provide assistance in specific cases. If this is assessed, it is in practice due to either payment default or insurmountable cooperation problems with parents, according to the interest organisation, which speaks on a general basis. &#8211; Terminating an agreement on a nursery place is something that is very much in the back of everyone&#8217;s mind in the sector. The consideration of the child will always weigh the most, and the vast majority of cases where termination is considered are resolved without this last means of action being used, PBL writes in an e-mail. PBL on termination of kindergarten places in private kindergartens &#8211; What right does a private kindergarten have to terminate a place in this way? &#8211; Kindergartens have the right to terminate an agreement on a kindergarten place if there is a significant breach, but consideration of the best interests of the child will always be most important in the assessments made by the kindergartens. The Kindergarten Act has several provisions which emphasize the necessity for the nursery and the home to work together to look after the child&#8217;s needs. If the guardian opposes contributing to a constructive collaboration with the nursery school, it can in rare cases result in the nursery school being unable to fulfill its duties in accordance with the Kindergarten Act. In such cases, termination of a nursery place could be the very last resort. &#8211; What grounds can possibly be used to cancel a child&#8217;s nursery place? In practice, there are two types of cases that occur again and again when a nursery school considers dismissal. One is payment default, and the other is insurmountable cooperation problems with parents. For example, cases with insurmountable cooperation problems may be about employees being repeatedly threatened or harassed by guardians, or that guardians fail to contribute to constructive cooperation in the best interest of the child. Technically, the justification is that one party in a contractual relationship makes the other party unable to fulfill its part of the agreement. &#8211; Does PBL know of cases where children have had their place canceled in this way? If so, how common is this? &#8211; Yes, we know of such cases, but it is very unusual. Terminating an agreement on a nursery place is something that is very much in the back of everyone&#8217;s mind in the sector. Consideration for the child will always weigh heavily, and the vast majority of cases where termination is considered are resolved without this last resort being used. Compared to how many children attend private kindergartens, cancellations of places constitute a very marginal number. The parents&#8217; lawyer has pointed out in a letter to the kindergarten that the termination is invalid and says it is not authorized by law or regulations. &#8211; As we understand it, this issue has never been tried in court, says Brage Berg\u00e5ker.
