NRK wrote about this case when the man in his 20s appeared as a defendant in the district court and was found guilty.  The soldier from the Telemark battalion was out in the woods with two colleagues to light a fire and enjoy themselves.  They became aware of a tiur in the area.  They tried to throw snow at the bird to get it away, but eventually decided to move to another location instead.  But when the soldier was about to retrieve his sack, he was attacked by the tiuren.  The man has explained that he tried to run from the forest bird.  But he stepped on the crowd and got stuck with one foot.  He tried to scare the bird by shouting at it and making himself big, but to no avail.  Chopped with the knife According to the man, the large bird must have fluttered its wings, made a leap and jumped straight at his face.  In his hand he had a large knife he had recently used to make firewood for the fire.  He responded by hitting the tiur&#8217;s head with the knife.  The bird must have gone straight to the ground, rolled around and made some convulsions.  The soldier explained in court that he was in doubt whether the bird was dead, and for safety&#8217;s sake he cut over its neck.  Later he cut up the tiuren and put it on the fire to give the game easier access to eat it. He also cut off one foot, which he took with him.  CUT OFF: Tiuren&#8217;s head was cut off. Photo: the police Was convicted in the district court When the case was up in \u00d8stre Innlandet district court, the soldier was found guilty and sentenced to pay a fine of 10,000 kroner for violating the Biodiversity Act and the Wildlife Act.  However, he appealed the verdict.  The Eidsivating Court of Appeal has now acquitted him.  The Court of Appeal writes that they use the man&#8217;s explanation as a basis.  &#8220;Based on the principle that it is the prosecuting authority that has the burden of proof in criminal cases, and that all reasonable doubt shall benefit the accused, the Court of Appeal bases the defendant&#8217;s explanation,&#8221; the court writes.  The two colleagues who were with him during the forest trip are said to have been 5-10 meters away when he killed the ten.  Their explanations agree with the soldier&#8217;s, the court believes.  Officer notified the police An officer from Rena Leir reported the case.  He had been called by a colleague, who had seen a group of young adults on a leisure trip.  The officer was told that the gang had met a tiur, on whom they had thrown snow and teased, at the same time as they laughed and barked.  The tiuren had been played, and one of the gang had cut after the tiuren with a knife and killed it.  The officer went out and found the soldier who had killed the tiuren and reported it to the police.  CHARTER IN THE BREAST: The thigh was also inflicted with a wound in the chest. Photo: police Emergency guardian According to the Court of Appeal, the stabbing of the tiuren is objectively a violation of the Biodiversity Act and the Wildlife Act.  But the court has thus come to the conclusion that the soldier acted in self-defense.  &#8220;Tiuren was very close to the accused, he therefore did not have time to consider or try out alternatives, and he had no opportunity to withdraw further,&#8221; the Court of Appeal writes.  According to the Court of Appeal, the actions were within what was required to remove a current and significant risk of injury to his person.
