Today, all rape victims have the right to three hours of free legal aid.  Among other things, this should help the individual decide whether or not to report the matter to the police.  A committee, set up by the previous government, will remove this arrangement.  &#8211; A step in the wrong direction, says Amundsen.  Weakens legal certainty &#8211; This is a particularly vulnerable group that needs advice at an early stage in the case, says the lawyer.  He believes that removing the right to these three hours will make it worse for a group that already has poor legal certainty.  &#8211; If any changes were to be made to the legal security of persons who have experienced rape, it should be strengthened.  Don&#8217;t take away what little there is.  Big black numbers There are big black numbers when it comes to how many people are raped in Norway.  Amundsen believes the number in the dark will increase if legal aid is now scrapped.  Surveys show that most people who are raped do not report it.  This was most recently revealed in a large-scale survey earlier this year.  The police&#8217;s clearance rate for rape cases is also considerably lower than the overall average for all other crimes.  Around three out of four rapes reported in 2022 were not solved.  Has already cut legal aid The proposal to remove legal aid in three hours comes in addition to other cuts in the aid rape victims are entitled to.  Earlier this year, the new Violence Compensation Act came into force.  Rape victims then lost another right to legal assistance from lawyers.  Before the change in the law, it was part of the legal aid attorneys&#8217; job to help rape victims apply for rape compensation.  This is financial compensation you may be entitled to after a rape.  Also in cases where the case has been dismissed.  Now this has changed.  The assignment as legal aid does not include applying for compensation for violence from the state.  This is how a new wording in the Criminal Procedure Act, which came into force on 1 January this year, reads.  According to the Ministry of Justice and Emergency Preparedness, the regulations are simpler with the new Violence Compensation Act.  The ministry&#8217;s further comment on the changes regarding assistance for applying for compensation for violence can be read at the bottom of the file.  Will leave the responsibility to others When the committee recommends cutting more in the legal aid for rape victims by scrapping the scheme with three free hours, they also recommend that other aid services should be expanded.  Crisis centres, abuse reception centers and the police&#8217;s support center for victims of crime are services that can replace the hours of free legal aid, according to the committee.  But the abuse center in Oslo will not take over this task from the lawyers.  &#8211; We are a health service.  We do not have the competence to give advice on whether or not to report.  That&#8217;s what Eline Thorleifsson, head of the abuse reception, says.  She is not impressed by the proposal.  We are a health authority and cannot take responsibility for legal assistance to victims of abuse, says manager of the abuse center in Oslo, Eline Thorleifsson. You would never send a patient who has a health question to a lawyer.  &#8211; Cannot replace legal expertise Lawyer Amundsen agrees with Thorleifsson.  He does not think it makes sense to push the task over to other bodies.  &#8211; Crisis center and abuse center do a very important job.  But they cannot replace the expertise of a legal aid lawyer.  The management at the rape center in Oslo is currently working on a proposal for the new rape committee set up by the government.  Among other things, this committee will look at how victims of abuse are cared for by the support system.  Thorleifsson says that the importance of free legal aid is something they want to record to the rape committee.  &#8211; The abuse center wants to keep the arrangement as it is today, and cannot be a substitute for it, says Thorleifsson.  Will look at the whole The proposal to cut legal aid and instead expand other aid services comes from the legal aid committee.  This is stated in a study commissioned by the Ministry of Justice and Emergency Preparedness under the previous government.  Ingebj\u00f8rg T\u00f8nnessen led this committee.  She writes in an e-mail to news that the recommendations the committee has made are &#8220;linked to the entirety of the scheme that is proposed&#8221;.  &#8211; It is important to emphasize that the committee is not necessarily responsible for all individual elements in the proposal if these are assessed in isolation from the rest, writes T\u00f8nessen.  The Ministry of Justice and Emergency Preparedness has also read this case.  State Secretary Hans-Petter Aasen points out that the ministry has set up a working group to investigate a first-line service for legal aid. A frontline service for legal aid would be able to help meet this challenge and correct biases created by the previous government.  The government also looks forward to receiving the rape committee&#8217;s report in January 2024, writes Aasen.  Response from the Ministry of Justice and Emergency Services regarding compensation for violence and assistance attorneys The Ministry of Justice and Emergency Services has given the following comment on the change in the law, which means that assistance attorneys will no longer assist in applying for compensation for victims of violence as before: Under the new law, approximately 70 percent of compensation for violence cases will be processed by the courts, and the vast majority of victims of violence will then be represented by a legal aid lawyer.  In these cases, it is the legal aid attorney&#8217;s task to look after the interests of the victim of violence and advance any compensation claims.  By comparison, 60% of victims of violence who applied for compensation under the old law had their expenses for legal assistance covered.  In those cases under the new law which are not dealt with by the courts (e.g. because they are dropped), legal fees must be covered if the scope or complexity of the case so requires.  In this way, legal expenses will be covered by the state in those cases where the needs of victims of violence dictate it, so that the scheme will be more effective, while legal certainty is safeguarded.  The fact that the regulations become simpler, the scope of action is linked to penalty orders, and the damage condition is removed, also simplifies the proceedings in cases that have not been dealt with by the courts.
