DO NOT VOTE: Secretary General Ingvild Bretten Berg abstained from voting at the FIS Congress Photo: Ali Zare / NTB In the presidential election in May, Swedish-British Johan Eliasch was elected with 70 votes. Eliasch was the only candidate, and that was why his name was on all the ballot papers that were counted. But that way of voting was controversial even before the voting. The chairmen of the meeting wanted elections by acclamation, but 15 nations requested that the elections be conducted in a different way. Several of them left the meeting room before the vote. The 15 asked in writing for an implementation of the election in such a way that they followed democratic principles according to Swiss rules, writes the Ski Association’s general secretary Ingvild Bretten Berg in an e-mail to news. It was she who was to vote for Norway. – But Norway abstained from voting during the election, as we perceived the election system as unclear, Berg writes. The 15 nations would be allowed to vote yes or no to Eliasch, or to vote blank. FIS rules on the presidential election 10.10.2 Election of the President 10.10.2.1. The President shall be elected by a majority of more than 50% of all valid votes cast. 10.10.2.2. The President shall be elected by open voting, unless the Congress, at the request of a Delegate or a Council Member, decides by a majority of all votes cast that the voting shall be by secret Ballot. 10.10.2.3. If no Candidate obtains a majority of all votes cast in the first round, there will be a second round in which the Candidate with the fewest votes in the first round is eliminated. 10.10.2.4. The procedure specified in article 10.10.2.3 shall be repeated until a Candidate receives a majority of more than 50% of all valid votes cast. Voting shall continue such that there will be no postponement between the voting rounds. 10.10.2.5. In the event of a tie between the two Candidates with the fewest votes, there will be an intermediate voting round to determine the Candidate who is eliminated in the election. In case of two further ties, the winner will be determined by way of a draw. – An election where the delegates have only one choice, to vote yes to the candidate, is not in accordance with our understanding of the regulations, and is only a farce, says Stefan Schwarzbach from the German Ski Association. Germany, together with Austria, Switzerland and Croatia, have taken the case to CAS. Eliasch’s 70 votes are still more than half of the 126 he could have received, including the delegations that left the congress hall. WAS ATTENDED: Sverre Seeberg meiner valet was unnecessarily square. Photo: Frode Søreide / news – Unnecessary square – This was an unnecessary square of the meeting leadership, which created a situation that could have been avoided, says Sverre Seeberg to news. The longtime former ski president and board member of FIS was present at the congress as a guest. – Elections for FIS president have always gone smoothly. I have never experienced anything like this, he says. But he adds that he does not know the rules for presidential elections in detail. Nor does Ingvild Bretten Berg go into detail enough to say whether the regulations are clear enough when it comes to voting. – It is Swiss business rules that apply, and without having read the mood of CAS, I want to believe that it is these rules that are at the core of getting the election assessed, she says. FIS’s director general Stephan Netzie defends the conduct of the election. – There is no yes or no. If you vote for the candidate, you use the ballot paper with his name. Certainly not, you did not vote, he says, according to insidethegames.biz. news’s sports commentator Jan Petter Saltvedt does not think the appeal to CAS will lead to new elections. – There is a theoretical chance that CAS can mean that because no one could vote secretly blank or no to Eliasch, it could even have that he had not received 50 percent and been elected. In that case, a new congress is needed. But it will take a lot more. The most FIS can get is a correction, but without other consequences, Saltvedt believes. Controversial leadership style PRESIDENT: Johan Eliasch. Photo: JOE KLAMAR / AFP Eliasch has had a controversial leadership style the year he was our president. Among other things, he has pushed for FIS to take ownership of all World Cup races, where every single nation now has the rights. It has hurt especially hard for alpine powers such as Switzerland and Austria, which have recently sold the TV rights to World Cup events in their countries, and which have budgeted with the income from there in the next few years. – That Eliasch has gone so hard with this without discussing it with the leading nations, has created dissatisfaction. That is probably one of the reasons for the strong reactions, says Saltvedt. TAKES THE CASE: CAS has confirmed that they will consider the appeal, but will not say anything about when they have the conclusion ready Photo: DENIS BALIBOUSE / Reuters Trust in new election Trond Solvang is a law professor at the University of Oslo, and an expert on CAS ‘work. He too has little faith that the appeal will succeed. – Yes, I have a hard time imagining that they will be supported in CAS. And should they be completely unexpectedly upheld, an extraordinary congress must be convened for a new vote, and it is then likely that the same candidate would be re-elected. – What do you think about the case and that four countries have appealed the election? – It must be seen in connection with the nomination process. No other candidates had been registered for the election, and then only he was relevant. Then it is common for an acclamation to be carried out, ie an informal approval of the candidate, and often a form of applause. – If there were to be a yes / no vote with only one candidate, one would risk being without a candidate in the absence of yes votes, Solvang tells news. – How special is this case? – It does not often happen, no. It is quite unusual, says Solvang. Ingvild Bretten Berg will not predict the outcome. “CAS is an arbitral tribunal, and I have no intention of saying anything about CAS ‘handling of this case,” she says.

ttn-69

CAS confirms that it has received the appeal, and will appoint a committee to decide the case. – But it is impossible to say anything about when we come to any conclusion, write CAS in a press release.
