Furthermore, the <strong>Central Economic-Administrative Court<\/strong> (TEAC) ruled that this deduction applies even if the acquisition occurred after 2013, following the elimination of the investment deduction on IRPF.<\/p>\n<h2 class=\"ue-c-article__subheadline\">When One Ex-Spouse Uses the Home, but Mortgage Payments Are Shared<\/h2>\n<p class=\"ue-c-article__paragraph\">In this case, the ex-spouse who resides in the home can still apply the deduction for investment in their habitual residence on their IRPF. However, for the other spouse who is still paying the mortgage, the home is no longer considered their habitual residence.<\/p>\n<p class=\"ue-c-article__paragraph\">Nonetheless, if after the divorce, the home remains the habitual residence for their <strong>ex<\/strong> and their <strong>children<\/strong>, the deduction for the mortgage can still be applied. &#8220;It is important to highlight that the taxpayer can only apply the deduction based on their <strong>percentage of ownership over the home<\/strong>,&#8221; detail experts from the law firm <strong>\u00c1tico Jur\u00eddico<\/strong>.<\/p>\n<h2 class=\"ue-c-article__subheadline\">When One Ex-Spouse Keeps the Home and Pays 100% of the Mortgage<\/h2>\n<p class=\"ue-c-article__paragraph\">The ex-spouse who, after the divorce, remains as the property owner but stops paying the mortgage will not be able to deduct the IRPF for the home.
