And he has the right to be considered innocent until the contrary is proven.  This also applies even if the prosecution now believes the evidence supports an indictment.  It took time for the Attorney General to reach his conclusion, and it was hardly an easy decision.  It is said that the public prosecutor himself must be personally convinced of guilt if an indictment is to be issued.  In addition, he must be sure that the evidence in the case is sufficient for the defendant to be convicted.  But proving a 27-year-old murder beyond a reasonable doubt is in itself a demanding task.  Nor is it made any easier by the defendant denying any connection to the case.  It is known that the police believe they have found DNA that cannot come from anyone other than the Karm\u00f8y man.  The defendant is also described as a modus candidate, because he has been convicted of violence and sexual advances towards women.  He has also been convicted of a number of burglaries, where he allegedly stole skirts, bras and women&#8217;s shoes, among other things.  The accused also lacks an alibi for the night of the murder.  He was also well-known locally on Karm\u00f8y, and he had a car that was similar to the one that several witnesses have described from the center of Kopervik on the night of the murder.  The question is whether all this holds.  It is expected that the 52-year-old&#8217;s defenders will put a lot of effort into creating doubt about the DNA evidence.  It is easy to imagine that they will spend time in court to shed light on possible contamination, in other words that the defendant&#8217;s DNA may have ended up on Birgitte&#8217;s pantyhose via another person.  In addition, the lawyers will probably point to other perpetrators, it has even been announced that they will present evidence regarding the old criminal case against Birgitte&#8217;s cousin.  Three months have been set aside for the criminal case in Haugaland and Sunnhordland District Court.  Only sometime after the New Year will we know whether the prosecution is successful in that the right man has now been caught.  But we can already state that there will be consequences if he is acquitted.  Of course, the 52-year-old should be acquitted if the evidence does not hold up, but such an outcome will probably have serious consequences for people&#8217;s trust in the police and the prosecution.  In other words: They cannot afford to fail again.  Because Spain is the victim of the serious mistakes that have previously been made in this case.  The cousin of Birgitte Tengs has had to flee the country because of the strain the case has put on him.  The cousin was prosecuted and convicted in the district court, but acquitted by the jury in the court of appeal.  There he was nevertheless sentenced to pay compensation to Birgitte&#8217;s survivors, because the judges believed it was likely that he had committed the murder.  The cousin still has that compensation judgment hanging over him.  Because it is a civil judgment, it has long since expired, and the courts have so far found no way to overturn it.  But the new indictment must undoubtedly lead to the court reconsidering this.  Otherwise, you run the risk of two different people being convicted in the same murder case.  And regardless of the new indictment, it seems quite clear that the cousin had nothing to do with the murder.  Then the rule of law must take action so that his case is cleared up. Then it remains to be seen whether this time we will know for sure who cruelly killed an innocent 17-year-old this May evening on Karm\u00f8y.  An answer is necessary, especially out of consideration for Birgitte&#8217;s parents.  They lost their only child, and she was killed just a few hundred meters from her childhood home.  But it is also important for the entire Karm\u00f8y community to reach a conclusion in this case.
