The Radical Change Party announced the presentation of a \u00a0criminal complaint\u00a0 for \u00a0prevaricate\u00a0 and a \u00a0disciplinary complaint\u00a0 against the magistrates of the National Electoral Council (CNE), \u00a0Fabiola M\u00e1rquez\u00a0 and \u00a0Alba Luc\u00eda Vel\u00e1squez\u00a0. This action stems from their controversial decision to suspend the \u00a0sanctions\u00a0 imposed on the senators \u00a0Ana Mar\u00eda Casta\u00f1eda\u00a0 and \u00a0Tem\u00edstocles Ortega\u00a0, thereby allowing them to participate in the critical vote to choose the new \u00a0magistrate\u00a0 of the \u00a0Constitutional Court\u00a0.<\/p>\n

On \u00a0September 3, 2025\u00a0, the \u00a0community formalized\u00a0 the complaint before the \u00a0Supreme Court of Justice\u00a0 and filed a disciplinary complaint with the \u00a0Attorney General’s Office\u00a0 in \u00a0Bogot\u00e1\u00a0. According to the Radical Change Party, the magistrates in question incurred \u00a0prevaricate\u00a0 by issuing precautionary measures that, as claimed, contravene existing regulations and unfairly favor the sanctioned lawmakers.<\/p>\n

The heart of the issue lies in the sanctions that the \u00a0Ethical Control Council\u00a0 of Radical Change imposed on Senators Casta\u00f1eda and Ortega, which deprived them of a voice and vote within the party. Following notification of the sanction to Senator Casta\u00f1eda on \u00a0August 28\u00a0, both legislators filed \u00a0challenges\u00a0 with the CNE aiming to reverse the sanctions and regain their political rights.<\/p>\n

In response to these challenges, Radical Change initiated actions against the involved magistrates. The challenge against Alba Luc\u00eda Vel\u00e1squez was predicated on her affiliation with the \u00a0Historical Pact Movement\u00a0, which the party viewed as a significant \u00a0conflict of interest\u00a0.<\/p>\n

As a result, the party requested Vel\u00e1squez’s removal from any involvement in proceedings concerning precautionary measures, alongside the discussion and decision on Casta\u00f1eda’s challenge. According to party claims, the law dictates that such challenges be evaluated by the next available magistrate in alphabetical order, with resolutions made collectively in the \u00a0Plenary Sala of the CNE\u00a0. However, Radical Change asserts that \u00a0Judge Vel\u00e1squez\u00a0 dismissed the challenge and subsequently issued a precautionary measure that lifted the sanctions against Senator Casta\u00f1eda, allowing her to vote in the upcoming magistrate elections.<\/p>\n

Regarding \u00a0Tem\u00edstocles Ortega\u00a0, the party claims it was not properly notified of the challenge initiated by the senator before the CNE. Instead, they learned of this issue through a communication issued by the \u00a0Secretary of the Senate\u00a0. Following this incident, Radical Change similarly challenged \u00a0Judge Fabiola M\u00e1rquez\u00a0 for reasons akin to those cited in Vel\u00e1squez\u2019s case, citing a possible conflict of interest.<\/p>\n

Regardless of these challenges, M\u00e1rquez, also part of the Historical Pact, issued an order affirming an emergency precautionary measure, a move Radical Change has branded as \u00a0irregular\u00a0 and devoid of any \u00a0legal foundation\u00a0. The party contends that both magistrates acted contrary to established procedures by dismissing the challenges while adopting precautionary measures that lifted the sanctions imposed on the senators.<\/p>\n

Radical Change has formally requested that the \u00a0PLENA DEL CNE room\u00a0 and magistrates \u00a0Altus Baquero Rueda\u00a0 and \u00a0Maritza Mart\u00ednez\u00a0, duly competent to address the challenges, take immediate action to annul the questioned precautionary measures.<\/p>\n

In a related context, the \u00a0Movement Indigenous Authorities of Colombia (AICO)\u00a0 provisionally suspended the voice, vote, and political representation of Senator \u00a0Richard Humberto Fuelantala\u00a0, blocking him from participating in the election of the new magistrate of the Constitutional Court, as outlined in \u00a0Resolution No. 025\u00a0 from \u00a0September 2, 2025\u00a0.<\/p>\n

This sanction, rooted in \u00a0article 20, literal H\u00a0 of \u00a0AICO’s internal statutory regime\u00a0 and various articles from the \u00a0Political Constitution of Colombia\u00a0, stems from evaluating the senator\u2019s legislative actions in accordance with the official document. The party underscores that the \u00a0Constitution guarantees\u00a0 both the right to choose and the effective exercise of political representation, principles enshrined in multiple articles of the \u00a0Magna Carta\u00a0.<\/p>\n

The measure has temporarily stripped the sanctioned senator of their spokesperson role and participation in party decisions, consequently excluding them from the pivotal vote on electing the new magistrate for Colombia\u2019s \u00a0Constitutional Court\u00a0, a decision critical to the legislative agenda. The Senate of the Republic of Colombia is set to name the new magistrate in a \u00a0plenary session\u00a0 this Wednesday, a highly anticipated decision that could shape the influence of the court on the national legal system.<\/p>\n
