However, it also includes \u00a0tax obligations\u00a0 that should not be overlooked. Failing to meet these obligations\u2014primarily the Declaration in the \u00a0IRPF\u00a0 (Income Tax for Individuals)\u2014can result in severe penalties for property owners. As indicated by taxation experts at \u00a0TaxDown\u00a0, non-compliance can lead to significant fines.<\/p>\n<p><!-- BREAK 2 --><\/p>\n<h2>What Constitutes a Habitual Home?<\/h2>\n<p>To be classified as a habitual home, a property must meet certain requirements. Merely visiting a property every weekend does not qualify it as a habitual residence; a person cannot have two habitual homes simultaneously. Changes in one&#8217;s habitual home must be justified for reasons related to work, marital circumstances, or other significant causes such as \u00a0disability\u00a0 or \u00a0natural disasters\u00a0. According to the Tax Agency, the main residence must fulfill the following criteria:<\/p>\n<p><!-- BREAK 3 -->  <\/p>\n<ul>\n<li>It should be the taxpayer&#8217;s residence for a continued period of at least \u00a0three years\u00a0.<\/li>\n<li>The taxpayer must have occupied it effectively and permanently within a \u00a0twelve-month\u00a0 period from the date of acquisition or completion of works.<\/li>\n<\/ul>\n<p>Any home that does not meet these criteria may be considered a \u00a0second residence\u00a0 for tax purposes. As emphasized by the \u00a0Iachorro\u00a0 portal, properties not utilized as a habitual residence will not benefit from the \u00a0tax exemptions\u00a0 that apply to primary homes.<\/p>\n<p><!-- BREAK 4 --><\/p>\n<div class=\"article-asset article-asset-normal article-asset-center\">\n<div class=\"desvio-container\">\n<div class=\"desvio\">\n<div class=\"desvio-figure js-desvio-figure\"><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<\/div>\n<h2>If it is Not Habitual Housing, It is Heritage<\/h2>\n<p>According to \u00a0Article 85\u00a0 of the Spanish fiscal legislation, properties that are not classified as habitual housing must be included in the income statement. This rule holds true whether these properties are rented out, inhabited for short periods such as holidays or weekends, or remain vacant.<\/p>\n<p><!-- BREAK 5 --><\/p>\n<p>As reported by \u00a0The Independent\u00a0, if a second residence is leased, the income generated must be declared as \u00a0real estate capital yields\u00a0, along with the appropriate deductions or taxes. Conversely, if the property is vacant and used sparingly throughout the year, it must be reported as &#8220;properties not involved in economic activities,&#8221; indicating its unused status. In such cases, the Tax Agency imputes a value of \u00a02%\u00a0 of the cadastral value, or \u00a01.1%\u00a0 if the value has been updated within the last \u00a0ten years\u00a0.<\/p>\n<p><!-- BREAK 6 --> <\/p>\n<h2>Consequences of Incorrect Declaration<\/h2>\n<p>Failure to accurately declare a second residence can be classified as \u00a0tax evasion\u00a0, resulting in penalties. According to the \u00a0Income Tax Law\u00a0 for natural persons, the severity of the internal violation influences the amount of the fine.<\/p>\n<p><!-- BREAK 7 --><\/p>\n<p>According to information shared by RTVE, if the undeclared amount is less than \u00a0\u20ac3,000\u00a0, the fine is \u00a050%\u00a0 of that amount, capped at \u00a0\u20ac1,500\u00a0. However, if the undeclared amount exceeds this threshold and there\u2019s evidence of concealment, the fine can escalate between \u00a050% and 100%\u00a0. In extreme cases, where fraudulent means have been used to hide assets, penalties can reach up to \u00a0100%\u00a0 to \u00a0150%\u00a0 of the undeclared amount.<\/p>\n<p><!-- BREAK 8 --><\/p>\n<p>These sanctions aim to ensure compliance with \u00a0tax obligations\u00a0 and discourage tax evasion. Additionally, interest on delayed payments may be applied, leading to even higher costs for non-compliant homeowners.<\/p>\n<p><!-- BREAK 9 --><\/p>\n<p>The debate around housing and taxation in Spain is increasingly urgent. As the economy fluctuates, resources to ensure compliance need to evolve similarly.
