This astronomical figure is nearly three times greater than the next highest fine levied against Vueling, also of which was due to non-compliance with hand luggage regulations.<\/p>\n<p><!-- BREAK 1 --> <\/p>\n<p>The aftermath of this ruling has implications for other operators in the region. Just recently, the Supreme Court has confirmed a \u00a050 million euro fine\u00a0 imposed on Renfe by the National Commission of Markets and Competition (CNMC). The penalty stemmed from allegations that Renfe stymied the liberalization of the merchandise transport sector.<\/p>\n<p><!-- BREAK 2 --><\/p>\n<p>As reported by <em>The Confidential<\/em>, this judgment gives Renfe a potential pathway to face an increased penalty, possibly escalated by another \u00a015 million euros\u00a0, pending evaluation by the National Court. The ruling stated that the company had &#8220;participated in collusion that hindered competition in the railway transport of goods.&#8221;<\/p>\n<p><!-- BREAK 4 --><\/p>\n<p>This sanction dates back to \u00a02017\u00a0, when Renfe Operadora was hit with the \u00a049.9 million euro\u00a0 fine, while Renfe merchandise incurred an additional penalty of \u00a015.13 million euros\u00a0 that should be paid separately. Deutsche Bahn was also fined \u00a010 million euros\u00a0.<\/p>\n<p><!-- BREAK 5 --><\/p>\n<p>According to the CNMC, both Renfe and Deutsche Bahn entered into an agreement back in \u00a02008\u00a0 that obstructed the liberalization of merchandise transport within Spain. In stark contrast, other operators faced \u00a0onerous conditions\u00a0 and had their requests for traction services denied.<\/p>\n<p><!-- BREAK 7 --><\/p>\n<p>This situation was further corroborated by the Association of Private Railway Companies (AEFP), which filed the initial complaint. They contended that they were subjected to \u00a0discriminatory treatment\u00a0 far less advantageous than that offered to Deutsche Bahn.<\/p>\n<p><!-- BREAK 8 --><\/p>\n<p> To date, the National Court has upheld two rulings confirming the penalties. In the latter ruling, it clarified that no violation of the non bis in idem principle occurred, meaning that Renfe was not penalized twice for the same offense.<\/p>\n<p><!-- BREAK 9 --><\/p>\n<p>Compounding matters, Deutsche Bahn decided to appeal, eventually reaching the Supreme Court. Renfe also initiated \u00a0cassation resources\u00a0, which have thus far yielded setbacks for them in the High Court.<\/p>\n<p><!-- BREAK 10 --> <\/p>\n<p>The latest determinations by the court indicated that the National Court had failed to fully appreciate the arguments presented by the plaintiffs, and it did not adequately justify why it dismissed their claims.
