The trio, who were members of Regiment 6 of Mercedes, had originally been sentenced to <b>life imprisonment<\/b> by Federal Oral Court No. 2. However, following a review of the case, <b>their convictions were reduced<\/b> for crimes against humanity.<\/p>\n<p>The Chamber, composed of judges <b>Mariano Borinsky<\/b>, <b>Javier Carbajo<\/b>, and <b>Gustavo Hornos<\/b>, decided to reject all challenges presented by the defenses, as well as those from the Public Prosecutor&#8217;s Office and other complainants. The original sentences, issued on October 24, 2024, by Tof No. 2, were thus upheld.<\/p>\n<h2>Details of the Sentences<\/h2>\n<p>In its initial ruling, the Federal Criminal Oral Court No. 2 sentenced Mart\u00edn Eduardo S\u00e1nchez Zinny to <b>12 years in prison<\/b> for co-authoring the murder of <b>Jorge Emilio Arancibia<\/b>, alongside an illegal deprivation of liberty affecting <b>Roc\u00edo \u00c1ngela Mart\u00ednez Borbolla<\/b>, <b>Pedro Oscar Martucci<\/b>, <b>Pablo Pavich<\/b>, and an unidentified individual.<\/p>\n<p>Similarly, Emilio Pedro Morello received a <b>10-year jail sentence<\/b> for his involvement in the same crimes, while Horacio Linari was also condemned to <b>10 years in prison<\/b> for identical offenses. Initially, Tof No. 2 qualified the charges as <b>homicide aggravated with alevos\u00eda<\/b>, resulting in life sentences. Both victims were later executed. Following this, four days later, another operation conducted in Haedo resulted in the kidnapping and disappearance of <b>Roc\u00edo Mart\u00ednez Borbolla<\/b> and <b>Pedro Martucci<\/b>.<\/p>\n<p>The defenses for Morello and Linari subsequently filed cassation appeals, asserting that <b>the sentences were excessively harsh<\/b> and that the court failed to provide a reasonable explanation for moving away from the legal minimum of eight years. Originally, the prosecutor sought a penalty of 25 years for each of the three defendants, considering the gravity of their actions as crimes against humanity.<\/p>\n<p>The prosecution stressed that the acts committed were part of a systematic, state-sponsored attack, enhancing their severity. The convicted individuals operated in secrecy with the intent to conceal their crimes, exemplified by the fact that Jorge Arancibia\u2019s body was found buried as an unidentified individual, only to be identified in 2018. The proposals from both defense and prosecution were seen as mere disagreements regarding the intensity and evaluation of the evidence presented, without any substantial omissions that would indicate arbitrariness in the original decision.<\/p>\n<p>Ultimately, the ruling reiterated that the perpetration of <b>crimes against humanity occurred under a de facto government<\/b> and emphasized that such context should be a factor in determining sanctions. Nonetheless, this context was less compelling given that the defendants were not linked directly to a clandestine detention center within the systematic plan of the junta.<\/p>\n<p>During the consideration of the defendants&#8217; age and rank, these were treated as mitigating factors, particularly because they were young, lacked significant military experience, and operated within a constrained decision-making environment.
