Convictions for Crimes Against Humanity Confirmed<\/h2>\n

Room IV of the Federal Chamber of Criminal Cassation has confirmed the review of the sentences against three repressors from Argentina’s last dictatorship, namely Mart\u00edn Eduardo S\u00e1nchez Zinny<\/b>, Horacio Linari<\/b>, and Emilio Morello<\/b>, the latter also serving as a national deputy from 1993 to 1997. The trio, who were members of Regiment 6 of Mercedes, had originally been sentenced to life imprisonment<\/b> by Federal Oral Court No. 2. However, following a review of the case, their convictions were reduced<\/b> for crimes against humanity.<\/p>\n

The Chamber, composed of judges Mariano Borinsky<\/b>, Javier Carbajo<\/b>, and Gustavo Hornos<\/b>, decided to reject all challenges presented by the defenses, as well as those from the Public Prosecutor’s Office and other complainants. The original sentences, issued on October 24, 2024, by Tof No. 2, were thus upheld.<\/p>\n

Details of the Sentences<\/h2>\n

In its initial ruling, the Federal Criminal Oral Court No. 2 sentenced Mart\u00edn Eduardo S\u00e1nchez Zinny to 12 years in prison<\/b> for co-authoring the murder of Jorge Emilio Arancibia<\/b>, alongside an illegal deprivation of liberty affecting Roc\u00edo \u00c1ngela Mart\u00ednez Borbolla<\/b>, Pedro Oscar Martucci<\/b>, Pablo Pavich<\/b>, and an unidentified individual.<\/p>\n

Similarly, Emilio Pedro Morello received a 10-year jail sentence<\/b> for his involvement in the same crimes, while Horacio Linari was also condemned to 10 years in prison<\/b> for identical offenses. Initially, Tof No. 2 qualified the charges as homicide aggravated with alevos\u00eda<\/b>, resulting in life sentences. However, the cassation deemed the facts more suited to charges of simple homicide and mandated a reassessment of penalties.<\/p>\n

Operation and Defense Arguments<\/h2>\n

Evidence presented at the trial demonstrated that on July 10, 1976, these agents kidnapped Jorge Emilio Arancibia<\/b> along with another militant from the Workers Revolutionary Party in a San Mart\u00edn residence. Both victims were later executed. Following this, four days later, another operation conducted in Haedo resulted in the kidnapping and disappearance of Roc\u00edo Mart\u00ednez Borbolla<\/b> and Pedro Martucci<\/b>.<\/p>\n

The defenses for Morello and Linari subsequently filed cassation appeals, asserting that the sentences were excessively harsh<\/b> and that the court failed to provide a reasonable explanation for moving away from the legal minimum of eight years. They also highlighted that the original sentencing took into account their youth and the non-leading role each defendant played, following orders from higher-ups.<\/p>\n

Public Prosecutor’s Perspective<\/h2>\n

The Public Prosecutor’s Office, alongside the Center for Legal and Social Studies (CELS), challenged the sentences<\/b> on the grounds that they believed there had been an arbitrary evaluation of the severity of the crimes. Originally, the prosecutor sought a penalty of 25 years for each of the three defendants, considering the gravity of their actions as crimes against humanity.<\/p>\n

The prosecution stressed that the acts committed were part of a systematic, state-sponsored attack, enhancing their severity. The convicted individuals operated in secrecy with the intent to conceal their crimes, exemplified by the fact that Jorge Arancibia\u2019s body was found buried as an unidentified individual, only to be identified in 2018. Meanwhile, the fates of Borbolla, Martucci, and Pavich remain unknown.<\/p>\n

Moreover, the prosecution argued that the defendants were not merely low-ranking operatives but were indeed army officers with command power and knowledge of the criminal enterprise<\/b> involved in these atrocities.<\/p>\n

In their judgment, the cassation noted that the sentencing proportions reflected a reasonable assessment of guilt by the Court. The proposals from both defense and prosecution were seen as mere disagreements regarding the intensity and evaluation of the evidence presented, without any substantial omissions that would indicate arbitrariness in the original decision.<\/p>\n

Ultimately, the ruling reiterated that the perpetration of crimes against humanity occurred under a de facto government<\/b> and emphasized that such context should be a factor in determining sanctions. Nonetheless, this context was less compelling given that the defendants were not linked directly to a clandestine detention center within the systematic plan of the junta.<\/p>\n

During the consideration of the defendants’ age and rank, these were treated as mitigating factors, particularly because they were young, lacked significant military experience, and operated within a constrained decision-making environment. In conclusion, the Federal Chamber of Criminal Cassation held that the contested decision was well-founded and that the sentences imposed were neither excessive nor disproportionate, maintaining consistency with established legal principles of guilt and proportionality.<\/p>\n
