He demands 90 million. The parents of Stine Sofie Sørstrønen (8) and Lena Sløgedal Paulsen (10) have not received any replacement for the Justice error. It creates reactions from the leader of the Law Society, chair of the Justice Committee and lawyer Stig Nilsen. Lawyer Stig Nilsen believes that the state also has a responsibility to the parents of the girls, who he also believes is clearly affected by the justice error. He believes the Monika case created case law on this. The leader of the Law Society, Sverre Bromander, provides a direct call to the Storting to look at the regulations for compensation and redress again. Helge Njåstad (Frp), chair of the Storting’s Justice Committee, says it will not be unnatural that the girls’ parents should also be compensated for what the rule of law has inflicted on them. The assistance attorneys for the parents of the killed girls both say they are awaiting judgment in the appeal against Jan Helge Andersen, before they will decide whether there is a basis for claiming compensation from the state as a result of the justice error. – Viggo Kristiansen’s right to compensation is legitimate. But it is important to see that the murder of justice also affects the killed girls ‘survivors, says lawyer Stig Nilsen, adding: – The girls’ parents have lived with wrong answers for years and have to go through new legal processes. The state should also be challenged in its responsibilities to them as well. That is why Viggo Kristiansen gets NOK 55 million Stine Sofie Sørstrønen (8) and Lena Sløgedal Paulsen (10) were raped and killed in Baneheia in the year 2000. Viggo Kristiansen was mistakenly convicted as the head of the Baneheia case. He served 21 years in prison and was sentenced to pay compensation to both girls’ parents. In 2022, Kristiansen was acquitted. At that time, Justice Minister Emilie Enger Mehl (Sp) regretted, and called the case one of Norway’s largest legal scandals. Civilian administration has awarded Kristiansen NOK 55 million in compensation. Attorney Brynjar Meling has announced a fight, and believes NOK 90 million is more correct. Meling argues that the appeal against Jan Helge Andersen is a huge burden on acquittal Kristiansen, and believes it sharpens the state’s liability. Pointing to the Monika case Nilsen is an experienced assistant lawyer, but he does not represent any of the parties in the Baneheia case. For many, he is best known for the Monika case, as a lawyer for Monika’s mother. Following several legal processes and interference from the government, Monika’s mother received justice remuneration from civil law administration, as a result of the justice error in the case. The lawyer believes it provided jurisprudence that is relevant to the parents of Stine Sofie Sørstrønen and Lena Sløgedal Paulsen. -There are obviously parallels between the Baneheia case and the Monika case. In both cases, a serious justice error that the state has acknowledged, says Nilsen. Stig Nilsen together with Monika’s mother, Kristina Sviglinskaja, when the case went to Nordhordland District Court in 2016. – It appears as a paradox that loss of children and lifelong stress has such low compensation protection, says Brækhus. He points out that the total compensation and redress the courts have awarded the parents is around NOK 1 million. Jan Helge Andersen and Viggo Kristiansen were sentenced to pay together in 2002. – Loss of children creates lifelong wounds in parents, Brækhus points out and further share about the parents’ stress. – The death of the children was due to the wild action and there has never been calm about the case. The killings were committed 25 years ago, but the case was not finally clarified by the courts. In addition, there are years of media coverage, which has often come unprepared for them. Photo: Ole Berg-Rusten / NTB asks the Storting to look at the rules leader of the Law Society, Sverre Bromander, emphasizes that he does not dispute Kristiansen’s claim for compensation. But it is unfortunate that the economic difference is so great. -The Baneheia case is a good example of how different the legislation turns out. It does not match people’s legal opinion. Bromander points out that the regulations for compensation from the state are different from the regulations for what courts judge perpetrators to pay in the uprising and compensation to the offended. – In criminal cases, Norway is known for having very low rates for financial loss such as torture and burning. At the same time, the understanding of the strain and psychological injuries has increased drastically last 25 years. Bromander has a clear call to the Storting. -The Baneheia case is obviously a wake-up call, and a good reason why the Storting should look at the regulations again. The leader of the Law Society, Sverre Bromander, believes the Storting should look at the regulations again. Photo: The Law Society Chair of the Justice Committee: – Has inflicted on them trauma as chair of the Storting’s Justice Committee believes Helge Njåstad (Frp) is generally taken into consideration in criminal cases and their survivors. -As a parliamentary politician, I cannot comment on individual cases, but the Baneheia case is something everyone in Norway has a close relationship with. I have sympathy for the parents of Stine Sofie Sørstrønen and Lena Sløgedal Paulsen, says Njåstad. – Does the state have liability for the girls’ parents, as a result of the justice error? – When there has been a legal scandal in Norway with justice murder, I think many agree that the victims’ survivors are also subjected to a traumatic experience. They must undergo several legal processes and relive the trauma from the actions in public space and in courtrooms, Njåstad replies, noting: – It is not unnatural that the parents of the victims should also be compensated for what the rule of law has inflicted on them with further trauma. Will consider legal action Assistance Attorney Brækhus welcomes the involvement of compensation. – Ada Sofie Austegard has since the killing been actively working in the Stine Sofie Foundation to strengthen children’s rights, including the criminal justice and compensation law protection for children and survivors, says Brækhus and adds: – In this context, you appreciate the attention of the compensation as offended and survivor. Especially compared to practice in other types of cases. Photo: Beate Oma Dahle / NTB – What do you think about possible liability from the state? Do you want to claim it? – Some may argue that there are other considerations that apply where the state has made a mistake than where a perpetrator is behind the injury, Brækhus replies and notes: – But in this case the state has also failed with regard to the survivors. I am awaiting the Court of Appeal’s judgment, and will then consider whether this can be followed up. Ask the court for higher amounts of lawyer Mette Yvonne Larsen represents the parents of Lena Sløgedal Paulsen. Previous courts have awarded them around NOK 4.2 million and NOK 3.1 million in raising and compensation. In the appeal against Jan Helge Andersen, the lawyer has requested that the requirement for uprising be raised with around NOK 1 million for each. Lena’s parents, Arne Bernt Paulsen and Klara Sløgedal, follow the appeal case in the Gulating Court of Appeal in Bergen. Photo: Ole Berg-Rusten / NTB-The requirement is calculated higher because there is interest, new basic amount and too low requirements the first round, explains lawyer Larsen. – Do you think the justice error triggers liability from the state to your clients? If so, will you seek compensation? – We will talk about that when the case is decided in the court system, Larsen replies. Larsen emphasizes that the parents have not applied for compensation for the justice error, and that compensation is thus not something the state has denied them or rejected.
