A black helicopter rushed in over the settlement, and finally landed on top of a roof. The pilot, and the homeowner, was Morten Larsen. He has had a certificate and helicopter for about four years and this was the first time he landed on his roof. The next day, the police called, he was suspected of two violations of the Aviation Act. Almost a year later, Larsen can breathe out &#8211; for court has decided that he has done nothing punishable. &#8211; I didn&#8217;t do anything wrong, so I was sure to win, he tells news. Will not land again there was a neighbor who had advised the police about the helicopter landing last summer. The indictment was that he had flown the helicopter over a densely populated area, as well as the construction of landing space without a license. Now the court has acquitted Larsen, who says he hopes it will not be an appeal. &#8211; I do not want to spend more time and resources on this matter, he says, adding: &#8211; Time I will spend on other things. This is stated by the indictment in Nordland has taken charges against Morten Larsen for violation of: Section 14 &#8211; 13, first paragraph, of the Aviation Act, in order to have violated the provision that an aviation vessel should not be kept in a negligent or careless manner so that the lives or property of others are jeopardized. Unless it is necessary for starting or landing, or with permission from the relevant authority, aircraft shall not be flown over urban buildings or over public gatherings in the open air. Section 14 &#8211; 21, cf. \u00a7 7 &#8211; 5, in order to violate the provision to construct, operate or hold landing space, a license is required from the Ministry. The indictment states that Larsen led a low altitude helicopter above densely built areas, and landed the helicopter on the roof, close to other buildings, with the risk of noise and\/or damage to persons. In addition, in the period in the autumn of 2023 to June 2024, in Narvik, he established a helicopter platform on the roof without having applied for and obtaining a license from the Ministry of Landing Place. On Monday this week, the verdict fell. It was the newspaper going forward that mentioned the verdict first. That night, Larsen celebrated with champagne. &#8211; Do you want to land on the roof again? &#8211; No, even though I&#8217;m allowed. I don&#8217;t want any more fuss about this. If there are some neighbors who do not like it is enough. I don&#8217;t want to bother anyone. &#8211; Glad for the verdict Larsen&#8217;s defender is also very pleased. &#8211; I think it is a good and well -written judgment, with both the right justification and results, says P\u00e5l Sveinsson. A central point of the indictment is about whether Larsen has flown over densely populated areas. According to the verdict, the court finds beyond any reasonable doubt that the defendant has flown over a closed airstrip, then over the railway rails, then over the industrial areas of LKAB, before the defendant eventually swung north and passed over two roofs before landing on his own roof. The last part of the approach, ie the passage over the roofs and landing on his own roof, was documented in court with several video clips. Larsen believes that his own videos showing the flight became the decisive evidence in court. &#8211; I could have been to show them. Then they had to prove that the approach vas careless. But I even presented the proof. Both parties had called in their own expert witnesses, all of whom are experienced helicopter pilots. None of them had anything to postpone the actual maneuvering of the helicopter at landing. &#8211; Based on the location of the accused&#8217;s house, he has flown into the track that involves the least possible flighting of densely populated areas and residential areas. The court therefore believes that if you first land on the roof in question, the flight lane that is chosen as sensible, the judgment states in the judgment. Larsen can now land here again, but says he doesn&#8217;t want to do it anymore. It was also documented that the helicopter has a noise impression of flights of 80.9 decibels, which corresponds to about the same noise level as a car at a short distance. &#8220;The court therefore faces a fairly clear case of a pilot that has floated a suitable helicopter, maneuvered well and chosen a sensible approach to land on the roof, the judgment states. Morten Larsen &#8211; I have never done anything wrong in my entire life, and then you are treated as a criminal. I fly well and safety is the most important thing, he says. The question the court left with was whether the approach and landing itself constitutes a violation of the European Aviation Rules (SERA). The rules regulate, among other things, the official requirements for aircraft height and emergency landing opportunities at start and landing. The court states that the wording in the Norwegian translation of the provision is linguistically ambiguous. The official versions in Danish and English are clear, saying that since Larsen flew low in connection with landing, the requirements do not apply. Larsen&#8217;s defender is pleased that the judges took the time to study the regulations. &#8211; This shows how complicated it can be when the EU&#8217;s regulations and directives become part of Norwegian law. Then translation problems can arise. That is perhaps what has happened here, says Sveinsson. It has not been decided whether the verdict will be appealed. &#8211; We note that the prosecuting authority has not been successful. As the police perceive it, the verdict seems difficult to harmonize with the Civil Aviation Authority&#8217;s understanding of the regulations. The verdict will be carefully reviewed in consultation with the Attorney General, says prosecutor Svein Maude.
