After a concrete assessment, the majority has come to the conclusion that the police officer can neither be punished for bodily harm nor gross misconduct. The judgment also states that a minority believed that the use of force in this case went too far and was punishable. They also believed that the police officer was liable for damages. 14 punches in 10 seconds On 30 October 2022, several people and police officers ended up in a powerful basketball attack at a petrol station in Kongsberg. There was a tense atmosphere at the front, and the policeman wanted to take Kevin Simensen with him for a chat. Simensen pulled his arm away, and the policeman put him on the ground. In April this year, Kevin Simensen and fellow victim Kristian Teigen were awarded compensation of NOK 30,000 and NOK 15,000. The commotion at the petrol station lasted for many minutes, and the policeman was also charged with two baton strikes against Kristian Teigen. Both said they were scared. The policeman has said he was worried about both his own safety and that of his colleagues. He believes that he acted in an emergency, since Simensen responded with strong resistance. It also turned out that Simensen had a baton and an illegal knife in his jacket, but the policeman was not aware of this when it happened. Kevin Simensen thought the blows from the policeman were unprovoked and he has said that he fought back because he was afraid. The policeman was acquitted in the district court, but sentenced to 120 days in prison in the court of appeal.
