On Thursday, Magnus Stangeland stood trial in Hordaland district court. The Norwegian Nature Inspectorate “caught him red-handed” at an illegal net at Stolmen in Austevoll last summer. The 83-year-old pleads guilty to the fact that the net was unmarked and stood illegally high in the sea, so that it could catch wild salmon. The prosecutor believes Stangeland should be sentenced to 30 days in prison on conditions for having placed the net unmarked and illegally high in the sea on purpose. The prosecutor also asks the court to recover NOK 410,000 – the value of the two boats Stangeland may have used to set out and take in the illegal net. In addition, he believes that Stangeland should be fined NOK 20,000 for “embezzling” the frozen salmon and trying to hide it from the police. The prosecutor pointed out that Stangeland is “a bald man” with 1 million in annual income and 33 million in assets. The illegal net was empty, except for one lyre. In the witness box he said that the salmon stocks in Hardanger migrate to the Norwegian coast and past Austevoll just around midsummer. That is why Mikkelsen reacted particularly to the discovery. This is how the illegal net floated on the surface when the Norwegian Nature Inspectorate discovered it. He testified in the district court case where Magnus Stangeland is accused of illegal net fishing. Forseth elaborated on the risk that illegal private fishing can have for wild salmon. – In the rivers with the most critical condition for the wild salmon population, only a few tens of fish return to the river. At least three or four times more are needed. He explained that a net like Stangeland’s therefore represents a great risk for the most endangered wild salmon strains. – If 10-20 salmon are caught on such a net, it can tip the situation over to the point where no fish return to the river, said Forseth. Tried to hide frozen salmon When the police searched Stangeland’s home later the same day, they found a frozen salmon. He had just before tried to hide it under a bush in the garden. – I guess I was a bit in shock and panic. I shouldn’t have done it, he said in court. He explained that this salmon had gone into a legally placed trawl net once before. Stangeland denied that he had ever fished illegally for salmon with nets. The prosecutor stressed that even if one accidentally catches wild salmon or aure in the net, one must throw it out again, even if it is dead. – Should fish for lyre, not salmon Stangeland explained that he had intended to fish for lyre on the June evening in 2023, and that he knew the legislation and the rules that should prevent wild salmon from entering the net. – As a former representative of the Storting, i.e. as a legislator, I familiarized myself with what is law and justice. I am quite clear that we must preserve the salmon stocks, he said. He claims he had trouble placing the net correctly, and chose to return in daylight the next morning. Then the Nature Inspectorate was hiding and waiting. – I deeply regret that I should get into this situation of being prosecuted for having fished salmon illegally. Photo: Statens naturoppsyn – Almost like killing myself Defense attorney Marie Hessen Jacobsen believes this is the wrong case to prosecute the principle of illegal fishing. – We are talking about one salmon found in an 83-year-old, she said. The prosecutor also believes that Stangeland should lose the right to net fishing for two years. Stangeland reacts to that. – It’s almost like killing myself. It is fishing that makes everyday worth living. My father was a fisherman. I have been fishing at home all my life, meaning for my own consumption, he said in court. The defense submitted a request for 15 days’ imprisonment on terms and a maximum fine of NOK 10,000. They rejected the claim to confiscate the boats, and asked the court to let the 83-year-old retain the right to net fishing. The verdict is expected next week.
