Both according to the provisions of the constitution and the ECtHR’s practice regarding Article 6 of the ECHR. We have therefore sent a complaint about PST’s public statements to the Ministry of Justice and to the Attorney General, says Heiberg. “Substantial” The defenders refer to several statements and call them “substantial”. They believe that the state has a responsibility to stop ongoing human rights violations. They believe PST’s statements violate Matapour’s rights, and they therefore refer to article 6, number 2 of the European Convention on Human Rights. “The fact that the person regards the person concerned as guilty before there is a verdict is to be considered an offence,” the lawyers write in the letter. Senior adviser Martin Bernsen in PST confirms to news that they are aware of the letter, but will not comment on it. – We are the recipient of a copy of a letter sent to the Ministry of Justice, says Bernsen to news. At the same time, we have also asked the ministry, as a representative of Norway as a state, to acknowledge that violations have taken place. – Now PST is a secret service. Could it not be that they are sitting on information that they cannot share and that makes them confident in their case? – We have repeatedly said that if such information is available, we expect it to be placed in the case in line with general Norwegian procedural law, so that we, as Matapour’s defenders, also get access. You obviously cannot process a public opinion with secret evidence without the defense being simultaneously given access to rebuttal, says Heiberg. news has not been able to get a comment from the Ministry of Justice.
