60 days of the sentence are suspended with a probationary period of two years. The woman must also pay NOK 170,000 in compensation to the child’s mother. The woman was prosecuted under Section 281 of the Criminal Code for negligently causing the death of another. On June 5, 2021, her Rottweiler attacked and killed the little boy. It happened while the defendant, who was the boy’s grandmother, was supposed to look after him and two other minor grandchildren. The woman had two dogs that got loose in a fenced area at the back of the house. A verandah door into the house was, however, open. An 87-centimeter-high gate had been set up in the veranda door, which was supposed to be an obstacle for the dogs. It was nevertheless here that the Rottweiler allegedly got hold of the boy, dragged him over the gate and out of the house. There, the one-year-old was bitten to death. Illustration: the police Deny criminal responsibility The woman was also charged with breaching the Dogs Act. She has pleaded not guilty to any of the charges against her. When she testified in the Østre Innlandet district court, she apologized several times for what had happened. The prosecution believes the woman has acted grossly negligent. The prosecutor, state attorney Magnus Schartum-Hansen, referred to several previous cases where her dog allegedly injured children. He believes that she should therefore have euthanized the dog earlier. In one case in 2016, a three-year-old girl had to have several stitches in her face after being bitten by the Rottweiler. A veterinarian who testified in court said that she recommended that the dog be euthanized already in 2016. Claims compensation The mother of the murdered boy has made a compensation claim against the accused woman of NOK 250,000. In court, the mother explained that she was afraid of the big dog. The woman stated that she has had significant psychological challenges after her son died. In court, she said that she feels a lot of anger and sadness. – I am angry because they did not listen to me and took me seriously when I was worried about the dog, she said. The murdered boy’s parents have separated after the tragic incident. The boy’s father described the Rottweiler in court as calm and obedient. – I have always believed that there was sufficient security with the dogs.
