What does it mean that Marius Borg Høiby can be detained? – news Norway – Overview of news from different parts of the country

Late on Monday evening, Marius Borg Høiby was arrested by the police. This is the third time Høiby has been arrested in less than four months. Since the latest arrest, the crown princess’s son has been in central detention in Oslo. He will remain there until Wednesday, the police confirm to news. But what will happen after that? The police are now considering whether to produce Høiby for remand. – It is a question they must decide on quickly. You can’t just arrest people without taking them to court, says Kjetil Kolsrud, who is editor of the newspaper Rett24. The police can hold an accused in custody for a maximum of 48 hours before they have to ask for the district court’s blessing to put the accused in prison, according to Norway’s courts. The most serious relationship Høiby is accused of is rape without intercourse. This relationship alone carries a maximum penalty of ten years in prison. Høiby denies criminal guilt for the alleged rape. In addition, one of the following reasons must be met: Risk of the accused escaping and not appearing when a possible criminal case begins. Risk of evidence being destroyed. There is a high risk that the accused will commit new, similar criminal offences. The accused himself wants to be remanded in custody. – The typical thing is the risk of repetition or the risk of evasion, says Kolsrud. Editor in Rett24 Kjetil Kolsrud believes the risk of recidivism will be an important factor in the police’s assessment of whether they want to present Høiby for remand. Photo: ISMAIL BURAK AKKAN / news – Risk of repetition is central The police arrested Høiby on Monday in a car near his home in Skaugum. – The accused was arrested because there is a risk of tampering with the charges, says police attorney Andreas Kruszewski to news on Tuesday. This means that the police feared that evidence in the criminal case could be lost if they did not place him in custody. When Høiby was arrested in mid-September, it was because the police accused him of breaking the restraining order he had imposed on one of his ex-girlfriends. On Tuesday, it became known that the police once again believe that Høiby has broken the restraining order against the same woman. – The risk of repetition is a central point that will be discussed, all the while this applies to a restraining order that has been broken several times. But then it depends on the circumstances surrounding this. It is not obvious what the answer will be, says Kolsrud. The district court decides Andreas Kruszewski says that the police have plans to decide whether they want to imprison Høiby by 10:00 a.m. on Wednesday. If the police decide that Høiby should not be produced for imprisonment, he will be released. If they instead believe that Høiby should be remanded in custody, the question must be dealt with by the district court. It is still not automatic that Høiby will be imprisoned, even if the police believe there is a basis for it. – It is the court that must assess whether the basis holds, explains Kolsrud.
