Concerns Over Santiváñez’s Appointment as Minister of Justice in Peru

The recent appointment of Juan José Santiváñez as Peru’s Minister of Justice and Human Rights has sparked significant backlash, particularly from the National Human Rights Coordinator (CNDDHH). The organization categorizes this move as a “serious setback” for the institutional integrity of the nation. Their position is that Santiváñez’s appointment poses a risk of impunity that primarily benefits a small group entrenched in political power.

In a public statement shared via social media platform X, the executive secretary of CNDDHH, Tania Pariona, expressed her deep concerns. She asserted, “The designation of Santiváñez as Minister of Justice is really a serious decline for the justice of our country. We alert citizens and the international community about how impunity is consolidated today. It seeks to favor a small group of political power currently in control of State powers.”

A troubling aspect of Santiváñez’s background is the existence of various complaints against him, including charges involving abuse of authority, personal cover-up, real cover-up, peculation, influence peddling, collusion, omission of functional acts, and money laundering. Moreover, he is currently facing a country departure impediment. The CNDDHH emphasizes that placing someone with such a controversial history in a ministry responsible for protecting human rights only underscores the regime’s political cover-up over merit-based appointments.

“We are no longer in a democratic system. Meritocracy is irrelevant; power dynamics are now dictated by how highly questioned factions operate,” Pariona stated, emphasizing the latent risk of human rights violations. She pointed out that Santiváñez’s prior tenure in the Ministry of Interior was marked by overt political allegiance to the current president, a trend she fears will resurface in his new role within the Ministry of Justice.

This growing concern has led the CNDDHH to urge the international community to remain vigilant about what they describe as an accelerated institutional deterioration. The position of key ministries has been filled with controversial figures enjoying dubious legal records, which unduly influences Peru’s commitment to the protection of human rights and combat against corruption.

The backlash against Santiváñez’s return to the Cabinet, notably after being censured as Minister of the Interior earlier this year, has been swift. Opposition figures including Alejandro Cavero from Avanza País labeled it as an “insult to the country,” while others, such as Sigrid Bazán and Ruth Luque, expressed similar sentiments of indignation and characterized it as an “antidemocratic and authoritarian” move.

Additionally, ongoing legal investigations against Santiváñez, such as those related to the “COFRE CASE”, where he is implicated in facilitating the escape of Vladimir Cerrón, the founder of Peru Libre, leave his legitimacy in question. With several complaints lodged against him, his track record makes him one of the most controversial and challenged ministers in recent history.

In light of these criticisms, Santiváñez has asserted that his efforts in the Ministry of Justice will focus on defending human rights and ushering in significant reform within the justice system. However, many detractors argue that his claims lack credibility given his troubling history and ongoing legal battles.
