The aggrieved women began their testimony in Trøndelag District Court on Tuesday this week. From before, three women have told their stories. On Wednesday, three new women will testify. The first woman begins to say that she felt the defendant was a fine doctor. And therefore went to the doctor. – When he listened to me, he commented on my tits. He said they were tight. I was not very old at this time, maybe 14 or 15 years old. Was concerned about women’s health himself. The victim goes on to tell about a gynecological examination at Arne Bye’s doctor’s office. Then she must have been told that she had glands in her vagina. And that it appeared that these had come because she was not particularly sexually active. She must have been told that these glands had to be emptied. – I was interested in the body and have actually been a champion of women’s health. I understood nothing of these glands. And neither is the processing of these. It was to massage the clitoris, says the woman. She says, choking back tears, that this felt completely wrong, and that she was afraid she would have an orgasm. – It was absolutely horrible. – I fixed my eyes on the ceiling and held the chair on the sides. She does not remember how many examinations she has had at Bye’s. Not guilty Arne Bye is accused of raping all three victims who testify in court on Wednesday. He himself does not plead guilty in these cases. What is rape in this case? The former municipal superintendent and general practitioner in Frosta is accused of having raped 87 women between 2004 and 2022. In the Criminal Code, obtaining sexual intercourse with someone who is unable to resist this is defined as rape. The former municipal superintendent is accused of inserting fingers and/or objects into the women’s vagina and/or anus. He is also accused of having “touched the clitoris in a masturbation-like manner”. According to the indictment, this must have happened in connection with medical examinations where the women sat in a gynecologist’s chair. They should not have had an overview of what the doctor did and were unable to oppose the actions. Arne Bye is accused of violating the Criminal Code 1902 § 192 first and second paragraphs and the Criminal Code 2005 § 291/§ 292 for rape by having obtained sexual intercourse with someone who was unable to resist this. The defendant explains in court that he most likely tried to “milk” or squeeze out contents from glands in the vaginal opening of the victim. But says that these glands are at a good distance from the clitoris. Bye says massaging the clitoris would be counterproductive, as these glands would have become larger, he explains. He also emphasizes that the patient has returned many times after what she describes as unpleasant situations at the doctor’s office. This week, no video evidence will be shown in court.
