Tolga municipality reaches a settlement with the Holøyen brothers in the Tolga case – news Innlandet – Local news, TV and radio

“The parties in the ‘Tolga case’ have reached an agreed out-of-court solution. The municipality has no comments beyond this.” Tolga municipality writes that on its website now. Avoids trial The trial between the brothers Magnus and Lars Peder Holøyen and Tolga municipality was to start in the Østre Innlandet district court at Tynset in January. In October 2020, the brothers demanded a total of NOK 3 million in compensation from Tolga municipality and the state. Today, Tolga municipality reports that they have reached a settlement which means that there will be no court case. The municipality’s lawyer, Jørgen L. Stræte, confirms this to news. The municipality does not provide any information about what the settlement entails. Placed under guardianship In 2018, VG revealed that Lars Peder (36) and Magnus Holøyen (27) had been registered as mentally disabled by the municipality without having a diagnosis. They were then placed under guardianship against their will. Afterwards, it was unclear who was to be held responsible. Tolga municipality rejected the compensation claim. The district court and the court of appeal believed that the lawsuit had to be directed against the state, not the municipality. But the Supreme Court agreed with the brothers that they had the right to sue Tolga municipality. Avoiding court proceedings Tolga municipality has therefore chosen to enter into some kind of settlement with the two brothers instead of waiting for the court case.
