Controversial Ruling by Andalusian Court Reinstates Justice in Inheritance Case
The Superior Court of Justice of Andalusia , Ceuta, and Melilla (TSJA) has made a significant ruling, ordering a retrial of a former case linked to inheritance management. This decision comes after they annulled a previous judgment made by the First Section of the Provincial Court of Seville, which condemned a man for failing to adhere to tax procedures related to an inheritance and practicing law without a degree. The individual was charged with undue appropriation and intrusion .
In a statement delivered by Judge Rafael García Laraña and reported by Europa Press, the TSJA addressed an appeal from the private prosecution, seeking to overturn the initial ruling after the accused filed an appeal against it. This decision is a pivotal moment in ensuring that the judicial process is upheld.
The TSJA has declared the proceedings null and void from the initial oral trial and mandated a new session with a different panel of magistrates. This directive seeks to eliminate any bias that may have occurred during the previous hearings, thus fostering a fairer trial for all parties involved.
The court emphasized “the unfeasibility of the same court dictating the new judgment due to its evident bias,” resulting in the annulment of the appeal submitted by the procedural representation of Jacinta Francisca DM . Originally, the First Section of the Seville Court handed down a sentence that included a prison term of one year and six months for Jesús RG, alongside a compensation order totaling 51,200 euros and a daily fine for six months.
The case revolves around an arrangement made between the complainant and the defendant, where Jesús RG was tasked with managing the complete inheritance processing following the death of the complainant’s husband, José CT . The complainant alleges that she handed over a total of 51,200 euros in three separate payments to facilitate this process.
However, allegations arose that Jesús RG had not completed essential procedures concerning the inheritance, including the payment of taxes associated with the estate and the registration of a property. This malpractice was particularly concerning as RG had previously handled another inheritance for the deceased’s family, for which he received over 59,795 euros , but did so while lacking a valid lawyer’s degree.
The relationship between the complainant and Jesús RG initially stemmed from RG managing another inheritance case, which further complicates the situation. The TSJA ‘s decision to invalidate the previous judgment was criticized for lacking a rational basis concerning the connection between the two inheritances and the transfers involved.
