1. New sanction options for breaches of the energy regulations RME calls for an expansion of the current response options to include administrative confiscation of profits for breaches of relevant regulations. It will be an effective reaction that ensures that the company does not weigh in on the action. If this is to be introduced, it will require changes to the relevant regulations. RME recommends that OED consider expanding RME’s competence to impose infringement fees on persons who contribute to breaches of the Energy Act and associated regulations. If this is introduced, it will require an amendment to the Energy Act. 2. Stricter requirements for knowledge of risk and efficient RME further advises that the current requirements in sales concessions be tightened by requiring electricity suppliers to declare that they are aware of the risk by offering agreements that provide for price protection, and can handle the risk linked to the agreements they offers. RME recommends a requirement of competence that is placed on the board, daily management and the company, which can contribute to increasing the confidence of end users and ensure that the management is suitable to operate in the mains electricity market. This will require an amendment to the regulations. 3. Withdrawal of a license on the basis of a breach of other relevant regulations RME advises that we should be entitled to withdraw a license on the basis of a breach of regulations other than the Energy Act and associated regulations. The purpose is to ensure a safe electricity market and sound regulation where breaches of other regulations have consequences for electricity suppliers. An extension of the current home requires an amendment to the Energy Act. 4. Individually adapt conditions to concessionaires RME advises to set separate requirements for power suppliers who have breached the regulations. This is to prevent the repetition of breaches of regulations. The purpose will also be to follow up electricity suppliers more closely. This will not require a change to the regulations, but will be a change in practice for RME. 5. Prohibition against entering into new agreements with end users In cases where electricity suppliers have seriously breached the regulations, RME recommends that a time-limited prohibition against entering into new agreements with end users can be put in place. Such a ban will help electricity suppliers to put an end to their possible illegal practices quickly, and will also have a general preventive effect. 6. New license for power suppliers In order to be able to adapt conditions and provide more predictability, RME will introduce a separate type of trading license for electricity suppliers.
