– He acknowledges the violence, says Christina Marie Steensnæs Winsor. She defends the minor boy who has admitted that he beat up Tor Inge Dahl on Karmøy last summer. He is 16 years old, but was 15 when the incident took place. Today the trial began. It ends on Friday. The boy is charged with grievous bodily harm against Dahl, who is developmentally disabled. Tor Inge Dahl was an active and cheerful man who wanted everyone well, according to his brother Martin. The victim was taken to hospital and fell into a coma. Now Dahl has woken up, but he is completely in need of care. Dahl suffered several fractures to his face, skull and bleeding on the brain. In the prosecution’s indictment, the boy was prosecuted under section 274 e). Penal Code § 274 e) Serious bodily harm is punishable by imprisonment for up to 10 years. When deciding whether the bodily injury is serious, particular emphasis must be placed on whether it has resulted in incurable blemish or injury, illness or incapacity for work of any duration or severe pain, significant injury or death, and otherwise whether it is motivated by the victim’s skin colour, national or ethnic origin, religion, outlook on life, homosexual orientation or disability. Disagreement about guilt, motive and consequences According to the indictment, the state attorney believes that the violence is motivated by Tor Inge’s disability. Defense attorney Winsor says there is no disagreement about the fight. – But there are disagreements about the subjective blame, the motive and the consequences, she says. Defendant, video interrogation of the friend who filmed and the witness who found Dahl lying unconscious. Unconscious man on the ground In State Attorney Arvid Malde’s introductory speech, he said that Karmøy ambulance station received information at 8pm on Saturday 12 August about an unconscious man on the ground at Vea. The police also received a report that Dahl had possibly been knocked down. The police arrived at 9.40pm that evening. There they came into contact with several young people, including the defendant. Photo: Privat Had drunk alcohol On Monday, a family member received a video that showed Dahl falling to the ground. In questioning, the defendant admitted nothing then. On 1 September, there was another questioning. The defendant admitted something, but also said he did not remember everything. Malde says the defendant had been visiting a friend and that they had drunk alcohol. The prosecution believes they can prove that the defendant asked his friend to film and that he then commits the act of violence. – Did not hit because he was developmentally disabled The defendant himself confirms having drunk alcohol. – I was going out to drink with some friends. I went to Vea and drank there, he said in court. What he remembers doesn’t match other people’s explanations, he says. – I partially plead guilty. I didn’t hit him because he was developmentally disabled. Thus, he disagrees with the accusation that the violence was motivated by Dahl’s disability. The 16-year-old defendant says he had never seen Dahl before. – I would never have hit him or anyone else if I had my brain in the right place, he says further. – Don’t remember He says he can’t remember the incident. – I don’t want people to think I’m a monster. It wasn’t because of his condition that I hit. I confess. I see from the evidence and the videos that it must be me, but I still don’t remember. In the first questioning, he denied hitting Dahl. – I saw the video and thought I was wearing different clothes that day. – You cannot remember the incident or say anything about why you hit. Is it correct? asked the prosecutor in court. – Yes, the defendant replies. – Feel sorry for him The battle at Tor Inge Dahl was filmed and shared on social media. The video was shown in court. – I feel sorry for him. I wish I could go back in time and change it, says the defendant in court. In his explanation, the boy said that he had been drinking alcohol before the incident and does not remember the actual blow. – What is happening is horrible, says the defendant after seeing the video in court.
