– I thought he deserved to sit there while I explained myself. So that everyone else could see his facial expression and body language. This is what the woman, who was in her 20s when she and two others notified the Norwegian Health Authority about Arne Bye, told news. Today she sat in court and gave her explanation about what happened at the doctor’s appointment in 2006. – I think it is far too late. This should have been done 18 years ago. The offended women can choose whether they want the defendant to sit in the courtroom or in a room next to it when they explain themselves. During her testimony, Bye sat in the courtroom, but mostly looked down at his own computer or wrote a note – without looking at the woman in particular. – Shame on myself During a gynecologist class, Arne Bye is said to have massaged the woman’s clitoris in a masturbation-like manner. For this, he is accused of raping the woman and abusing his position as a doctor. – I realized that he wanted me to have an orgasm, the woman told the court. What is rape in this case? The former municipal superintendent and GP in Frosta is accused of raping 87 women between 2004 and 2022. In the Criminal Code, obtaining sexual intercourse with someone who is unable to resist is defined as rape. The former municipal superintendent is accused of inserting fingers and/or objects into the women’s vagina and/or anus. He is also accused of having “touched the clitoris in a masturbation-like manner”. According to the indictment, this must have happened in connection with medical examinations where the women sat in a gynaecologist’s chair. They should not have had an overview of what the doctor did and were unable to oppose the actions. Arne Bye is charged with a breach of the Penal Code 1902 § 192 first and second paragraph and the Penal Code 2005 § 291/§ 292 for rape by having sexual intercourse with someone who was unable to resist this. In court, the woman told that Bye massaged the clitoris to empty what he called “hymen glands” But Arne Bye rejects this in court. – The fact that I should have carried out the stimulation so that the gland would empty, I reject that. The woman says that she has felt a sense of shame after what happened. – It is shameful to be caught in those areas there. To sit in such a position in a gynecologist’s chair where you cannot do anything, she says to news. The woman says she feels ashamed for not getting up and leaving. – It’s such a shame towards myself that I didn’t trust myself and go out, or say something. – Should I report or pretend nothing happened? The woman said that Arne Bye was well liked and the only doctor at Frosta. This made them unsure whether they should report what they had experienced. – Should I report it or should I pretend it’s nothing and just move on?, she says they discussed. Because they thought that Bye had been a good doctor up until then. – It was not easy to notify, because I had a good relationship with him myself. I was surprised by what he did. They decided to give notice – something that was not well received in the village. – There were a lot of reactions to the fact that there were some young girls who were rooting for him and reported him for improper treatment. – Arne Bye was well liked, so nothing positive came out of someone reporting, she adds. In the village, no one knew who it was who gave the warning, but everyone talked about it. – There were many rumors and it was tough. Many times I had to go and cry a little, the woman told the court. Wanted the others to be believed After the notice had been sent, she thought Bye had stopped the treatment she was scheduled for. – I actually thought he had quit after this notice. I haven’t heard any rumors afterwards that would suggest that he continued with these types of treatments. But when it became known in the media in August 2022 that a doctor from Trønder had been stripped of his authorization, she understood that he had not stopped. – I was shocked. I realized it right away. I will then send another notice to the state administrator that I think it is him. Where can you get help? She also pointed out that this was not just a rumor spread by some young girls. – This is actual abuse that they have been subjected to, writes the woman.
