Shared photos of sex on the dance floor – sentenced to suspended prison – news Vestfold and Telemark – Local news, TV and radio

In the Vestfold district court, the 19-year-old woman has been sentenced to 60 days in suspended prison, in addition to having to pay NOK 7,000 in compensation to the woman who was filmed. The woman is appealing the sentence. Should only be shared with a few The incident itself happened at a nightclub in Horten in October last year. There was a good atmosphere on the dance floor, and a girl and a boy in their late teens started dancing tightly wrapped around each other. Eventually, however, the dance steps developed into something far more intimate. The two lay down on the floor, where many of the guests witnessed what is said to have been a sexual act. The couple were allowed to remain undisturbed for a period, until the law enforcement officers on the scene were made aware of what was happening. The 19-year-old filmed at close range. Later in the evening, she chose to share the 10-second film on Snapchat. Shared with over a hundred people According to her, the plan was to share it with a few friends, but by mistake it was shared with over a hundred people on Snapchat. It had consequences. The woman who was filmed has explained that in the first few days she received around 20 messages from both known and unknown people, who said that a film of her with sexual content had been shared. She also said that to this day she receives messages on social media where people wonder if she is the girl in the film from the nightclub in question. There were also several other guests who filmed what happened. Among other things, a young man, who in April was sentenced to pay NOK 7,000 in compensation in connection with the same incident. Filmed to “joke” The defendant has explained that she knew that it is illegal to send sexualized images or films to others, but that she filmed to “joke”. She would show her friends what she perceived as shocking behavior. The 19-year-old therefore believes that she had the right to share the film because the victim had put herself in the situation. This is how she expresses it in the judgement: “When you lie down like that in a public place, you have to take responsibility for yourself.” – Exposed to exposure, the 19-year-old has already decided to appeal the sentence, says the woman’s defender, Jon Anders Hasle. – She feels it is unreasonable that she is the one who should be punished for sharing photos of an episode she never asked for. Lawyer Jon Anders Hasle defends the defendant, who has now decided to appeal the sentence. Photo: Aina Indreiten / news Hasle believes his client is being treated unfairly. – The reality here is that someone has had sex in a public place. It is basically a criminal offense to which she has been subjected, says the defender. He believes that his client is exposed to an illegal act in a public place, and that she therefore chose to share the experience. – She is exposed to exposure, which she films and broadcasts. That is not what this law should affect, says Hasle. – Would it have been an alternative to report the case, instead of sharing the pictures on Snapchat? – There are many alternatives in the clear light of hindsight that could have been done, but the question is whether it is punishable. It takes quite a bit before you use punishment against a person, says the lawyer.
