The actions must have taken place both at the school where the man worked and in the man’s home, and the indictment mentions that they took place from June 2021 to March 2022. For this, the man is being prosecuted in the Hordaland district court for breach of §304 of the Penal Code. The 22-year-old is also accused of having taken sexualised images of the boy, as far back as June 2020. He is also accused of having taken sexualised images of several other boys under the age of 16. For this, he is charged with breaching Section 305 of the Penal Code. The man is said to have taken pictures of boys at the school he worked at on two occasions after the summer of 2020. The indictment also mentions two occasions in the early summer of 2020. One of the young boys the man then took the picture of was participating in a leisure activity. This is what §304, §305 and §311 of the Penal Code say. These are the sections the former school employee is charged with having breached: §304. Sexual act with children under the age of 16: Anyone who commits a sexual act with a child under the age of 16 is punished with imprisonment for up to 3 years, if the relationship is not affected by § 299. §305. Sexually offensive behavior etc. towards children under the age of 16: Anyone who, by word or deed, exhibits sexually offensive or other indecent behavior in the presence of or towards children under the age of 16 is punished with a fine or imprisonment of up to 2 years. b. forces or induces a child under the age of 16 to engage in sexually offensive or other indecent behaviour, unless the relationship is subject to stricter provisions. Section 311. Production of sexual abuse against children or production that sexualises children With a fine or imprisonment of up to 3 years, whoever a. produces production of sexual abuse against children or production that sexualises children, b. publishes, offers, sells, hands over to another, available or otherwise seeks to disseminate representations as mentioned in letter a, c.acquires, introduces or possesses representations as mentioned in letter a, or intentionally obtains access to such material, d.gives a public lecture or organizes a public performance or exhibition of productions as mentioned in letter a, or e. induces someone under the age of 18 to allow themselves to be photographed as part of the commercial production of movable or immovable images with sexual content. In this section, children mean persons who are or appear to be under 18 years of age. Anyone who negligently carries out an act as mentioned in the first paragraph is punished by a fine or imprisonment of up to 6 months. In the same way, the owner or superior who intentionally or negligently fails to prevent an action being taken in a business as mentioned in the first paragraph is punished. The penalty can be waived for anyone who takes and possesses a picture of a person between 16 and 18 years of age, if this person has given their consent and the two are approximately equal in age and development. The provision does not affect representations that must be considered justifiable based on an artistic, scientific, informative or similar purpose. The provision also does not apply to films or videograms that the Norwegian Media Authority has approved for commercial screening or sales through prior inspection. When he was arrested on 11 March, according to the police, he had at least 7,800 different sexualized images and videos of children, i.e. persons under the age of 18. The police believe the man has been downloading abuse material since autumn 2016.
