The Legal Battle of a Mother Against Her Ex-Husband: A Case of Alleged Child Abuse
A mother from Guanajuato faced a horrifying reality when her ex-husband was accused of sexually abusing their two underage children. The case soon spiraled into a legal nightmare that tested the limits of the Mexican judicial system. Despite mounting evidence, a judge controversially released the alleged perpetrator, igniting a legal struggle that eventually reached the Supreme Court of Justice of the Nation (SCJN).

The couple, having been married for nearly a decade and parents to a seven-year-old boy and a six-year-old girl, separated amicably in September 2017. Custody of the children was given to the mother, who allowed the father to visit them every other weekend and one day during the week. However, as time passed, the father exhibited increasingly violent and intimidating behaviors towards his ex-wife. This prompted the mother to relocate with her children to Mexico City in May 2021, in an attempt to escape from his influence.
Despite the distance, the father continued to see his children, taking them back to Guanajuato on the weekends. However, the mother soon noticed concerning behavioral changes in her children after these visits. They exhibited signs of distress, prompting her to seek professional help. A psychologist confirmed her worst fears when she was told the children had disclosed they were victims of sexual abuse by their father. This horrifying revelation led the mother to take her children to a forensic psychologist specializing in child sexual abuse, who corroborated the children’s accounts.

The mother filed a complaint in August 2021 against her ex-husband for the sexual abuse of their children with the Mexico City Attorney General’s Office. Fearing retaliation, she sought safety in a jurisdiction where she felt less vulnerable. The investigation began promptly, involving interviews with the children, which further corroborated their claims. Following this, the case was handed over to the Guanajuato Attorney General’s Office, which successfully obtained an arrest warrant against the father, leading to his arrest in February 2022.
Shocking developments soon ensued when the Judge of Control in Guanajuato decided to release the accused, citing a lack of jurisdiction in the investigation process conducted by Mexico City authorities. This ruling prompted the mother to file an appeal, but the Ninth Penal Chamber of the Guanajuato Supreme Court upheld the release, dismissing the case once again.
Frustrated but determined, the mother filed an indirect amparo trial, eventually receiving a favorable ruling from the Fourth District Court, which acknowledged that while the evidence may have been initially deemed null, it warranted a reevaluation. Both parties presented further appeals, leading to the case now on the desk of the First Chamber of the Supreme Court of Justice of the Nation.

On January 22, 2025, the SCJN finally delivered its verdict, ruling in favor of the victims and against the perpetrator. The Court acknowledged that while the Mexico City Attorney General’s Office should have referred the case to Guanajuato from the onset, their actions were justified for the immediate initiation of an investigation. The Court emphasized the importance of protecting evidence pertinent to the case, preventing re-victimization, and ensuring the best interests of children were prioritized.
The SCJN concluded that the evidence collected by the Mexico City authorities was neither illegal nor unjustifiably obtained, and thus should not have been rendered null. This decision not only transformed the trajectory of the case but also shed light on critical issues surrounding child safety and legal accountability in the Mexican justice system.
