Municipal director Endre Skjervø asked the Norwegian Health Authority to investigate Arne Bye’s medical practice at Frosta – news Trøndelag – Local news, TV and radio

“Request that the Norwegian Health Authority initiates an investigation of all medical practices carried out by Arne Bye Frosta municipality hereby requests that the Norwegian Health Authority assists us and takes responsibility for establishing a “task force”/expert group with the necessary expertise in investigation, medicine and law, which can be made available to Frosta, so that a complete investigation of the entire medical practice Arne Bye has had at Frosta is carried out. We ask that this include a review of all patient records he has been involved with. By carrying out such an investigation, we can ensure that all patients who believe they may have been exposed to negligence in the treatment of illness, wrong diagnosis, wrong treatment or wrong medication, are seen and given the opportunity to have their patient history and their current health situation given a “second opinion”/renewed assessment from independent competent actors. We believe it is absolutely necessary and crucially important that all his patients are given such an opportunity to obtain the necessary medical and legal assistance to assess whether they have been exposed to errors or deficiencies in the treatment they have received, and that they are given access for guidance or other help in writing/registering a potentially justified application for patient injury compensation, if this is applicable. Such an investigation must be carried out using independent actors and resources outside Frosta municipality, who can safeguard both the patients and Arne Bye’s legal security, as well as ensure that we clarify the scope of any patient injury cases, and follow up on those that need to be uncovered, as well as given patients who are incorrectly treated, necessary help to get correct treatment. Increase in patients who tell about incorrect treatment Frosta municipality is now experiencing an ever-increasing number of people who tell about doctor-patient relationships where they believe they are exposed to shortcomings and mistakes in the treatment from Arne Bye, and where this is described as sometimes very serious and long-term injuries and negative consequences. The common denominator in these explanations is that the patient-doctor relationship is said to have been grossly abused to create trust and dependence at the same time that Arne Bye has either given false information about the need for medical examinations and/or lied about test results and/or made incorrect diagnoses and/or fail to treat illness, and/or lead the patients to an unnecessary course of treatment or other unnecessary contact with their doctor. For some of them, this has also been used as an opportunity to create repeated treatment with the doctor where they claim to be exposed to sexual abuse. This appears both as personal explanations given to employees in Frosta municipality, through statements in the media and through the fact that several have submitted applications for Patient Injury Compensation. This also came up as a theme at a recent public event held by the Patient Ombudsman at Frosta. It is likely that this type of treatment-related information will also come to light when the 95 victims participating in the trial begin their statements when the trial starts on 05.11.24. It is therefore highly predictable that the number of registered patient injury cases will rise significantly in the coming years. The scope of possible patient injury cases could include a number that is far greater than the women who have had the status of offended in the investigation. the topic of patient injury covers both women and men. At the time Arne Bye lost the right to practice as a doctor, he had approx. 850 patients. With a medical practice that stretches back to the end of the 1990s, such an investigation will include the treatment of an even larger number of patients. The medical service in Frosta cannot take on the task of investigation The medical service at Frosta is, in our opinion, both incompetent and without the necessary capacity, nor does it have the necessary competence/experience to operate such large and systematic investigation assignments. The service is to be regarded as ineligible due to that the current municipal chief physician has had a long-term close colleague relationship with Arne Bye, and the local GPs are too close to the situation and many of the patients in question. Summary The extraordinary situation at Frosta means that we should implement extraordinary measures, which go beyond the established routines. There will be a number of disadvantages to choosing a “wait and see strategy”. We then risk that it is only the most resourceful patients who win with their demands and who are seen and cared for. For Norwegian Patient Injury Compensation, a choice to remain in a normal state strategy where “all cases registered by patients are handled as usual”, could develop into a challenging large increase in case processing, with very long case processing times as a result. This will obviously be negative for the affected patients. With a gradual increase in patient injury compensation cases and increasing media coverage of this topic, the question of a larger investigation will most likely still force itself sooner or later. All affected institutions, services and people have a lot to gain from such investigative work being carried out thoroughly, by independents, and from it being started as soon as possible. We therefore request that the Norwegian Health Authority contributes to a full investigation of Arne Bye’s medical practice at Frosta.
