– Kongsvinger municipality is charged with having negligently caused the death of another, and the municipality is charged under section 19 of the Working Environment Act, which deals with system failure, police inspector Henning Klauseie says. It was 4 November 2022 that the 11-year-old ate parts of a wheat bowl containing milk protein at school and on the way home he collapsed. The boy died in hospital the next day, and the autopsy report concluded that he died as a result of a severe allergic reaction. The police believe that a system failure in Kongsvinger municipality meant that the teacher had not been told that the allergic reaction could occur one and a half to two hours after he ingested something he could not tolerate. Guardians and health personnel were not notified that the boy had eaten parts of a bowl before he went home from school. The submission to the municipality has been written by order of the State Attorneys in Hedmark and Oppland. If the municipality does not approve the proposal, the case will be sent to court. By not accepting the subpoena, the penalty discount will expire, and a claim for NOK 1.8 million in fines will be submitted to the court, as well as a demand to cover court costs.
