Justice gives a favorable opinion to the expulsion of the Algerian influencer “Doualemn”

The Hérault Expulsion Commission (COMEX), made up of three magistrates, made a favorable opinion on Wednesday, March 12, for the authorities to expel “Doualemn”, this Algerian influencer whose repression by Algeria had avenue relations between Paris and Algiers, said his lawyer.

“We are stunned by this decision, by the manifest disproportion between the threat to the public order which is advanced and someone who was sentenced to five months suspended and whose life and the family are in Montpellier”told the France-Presse (AFP) M agency^e Marie David-Bellouard.

“It is a political decision. Our client is taken in the vice and is a standard of the migration policy of this government ”she said after the notification of the advisory opinion of this commission, made up of two magistrates of the judicial court and an administrative judge.

Sentenced to five months suspended prison sentence

The Comex had held a contradictory public hearing on March 5 on the case of this 59 -year -old maintenance agent, Boualem Naman of his real name, at the request of the Hérault Prefect, who plans to take an expulsion measure from the territory against him. M^e David-Bellouard said that she would dispute in emergency procedure and on the merits any decision to expulsion from his client.

In early January, “Doualemn”, followed by some 138,000 people on Tiktok, had broadcast a video in which he called to inflict a “Severe correction” to an opponent of power in Algeria. He was sentenced on March 6 to five months suspended prison for “Provocation not followed by effect to commit a crime or an offense”for this broadcast.

She had already earned him a withdrawal from her residence permit and his expulsion on January 9 to Algeria in early January. But the Algerian authorities had immediately returned it to France, triggering a crisis with Paris. The Melun administrative court had then canceled its obligation to leave French territory (OQTF), enjoining the authorities to resume the procedure, this time with a contradictory debate, hence its passage before the Comex.
