– There was always a lot of pain, so you thought something was wrong. This is what the woman in her 40s says about gynecological examinations at Arne Bye. She is one of three women who reported the accused doctor in 2006. – I felt like the world’s biggest asshole actually. Who thought I would be able to see the doctor, she adds. Bye is accused of raping the woman when she was at his doctor’s appointment. In addition, he is accused of abusing his position as a doctor to obtain sexual intercourse. The case against the former municipal superintendent and GP in Frosta municipality will go to court from 5 November to 18 February. – He massaged the clitoris Woman in her 40s tells about several gynecological examinations at Arne Bye’s doctor’s appointment. During one of the examinations, Bye allegedly massaged the woman’s abdomen. The accused doctor must have explained to the woman about some cysts in the abdomen that could be manipulated away. – He had his fingers in the vagina and was massaging the clitoris, says the woman about what happened at Bye’s gynecological examination. The woman says that she asked her GP to stop when this happened. – It’s very embarrassing. It is shameful. It’s not something you want to talk about, says the woman about the episode at the doctor’s office. During a later doctor’s appointment, Bye is said to have taken a picture of the woman’s abdomen. – Then I was in the gynecologist’s chair with my legs up, naked. – I have thought in retrospect about what became of the ticket, she adds. The woman cried while she says that she has a bad conscience for not notifying the doctor before she did. – Then the veins of my child, neighbors and colleagues could have avoided this. – I felt I had no control over my own body A woman has already explained herself in court on Tuesday. She went to Bye because she struggled a lot with abdominal pain. – He said that there were some glands that were inflamed and that they had to be stimulated to empty them. The woman in her 30s is clearly distressed during her explanation and struggles to get the words out. – In certain periods I felt that I had no control over my own body. According to the indictment, Bye must have touched the woman’s clitoris in a masturbation-like manner during a consultation at the doctor’s office in Frosta municipality. For this, Bye is accused of rape and abuse of his position as a doctor. What is rape in this case? The former municipal superintendent and general practitioner in Frosta is accused of raping 87 women between 2004 and 2022. In the Criminal Code, acquiring sexual relations with someone who is unable to resist this is defined as rape. The former municipal superintendent is accused of inserting fingers and/or objects into the women’s vagina and/or anus. He is also accused of having “touched the clitoris in a masturbation-like manner”. According to the indictment, this must have happened in connection with medical examinations where the women sat in a gynaecologist’s chair. They should not have had an overview of what the doctor did and were unable to oppose the actions. Arne Bye is charged with a breach of the Penal Code 1902 § 192 first and second paragraph and the Penal Code 2005 § 291/§ 292 for rape by having sexual intercourse with someone who was unable to resist this. – It started to hurt so much. I told him to stop, but then he continued. The woman says this must have happened several times a year at Bye’s doctor’s appointment. At most, she must have been to Bye 40 times a year, she explains. – I knew that I only had to go through it if I was going to get well, she explains. Bye: – This has not happened Arne Bye does not admit to having done anything wrong to the woman in the 30s. In addition, he confesses to having massaged glands in the woman’s abdomen. – I strongly reject this. It hasn’t happened. Bye says that glands have not been a topic during his doctor’s appointments and that he has also not touched the woman’s clitoris. – At no time has it been indicated that I should carry out any massage of the glands to empty them, Bye says in court after the woman’s statement. The defendant has the opportunity to come up with an additional explanation after each of the offended women has explained himself in court. I was distraught and shocked by it, says the woman. The woman in her 30s explains that she was desperate to get rid of the pain, but that her body began to resist the treatment she received at Bye. And without improvement, the 30-year-old finally changed doctors. – At first I thought the doctor was cold, but gradually I realized that the doctor was professional, says the woman about the female doctor she switched to. The 30-year-old says she has repressed much of what is said to have happened at the doctor’s office, but she has now started to remember treatment. – I can’t go to the GP. I struggle to trust GPs. I know I can trust them, but my body still doesn’t, she adds. The indictment in the case against Arne Bye: On 17 September 2024, the indictment against the former municipal superintendent and GP was ready. The indictment deals with a total of 94 offended women. For all 94, the indictment violated the Criminal Code 1902 § 193 and the Criminal Code 2005 § 295 for having obtained sexual relations by abusing his position as a doctor. In 87 of the cases, he is additionally prosecuted for a breach of the Penal Code 1902 § 192 first and second paragraph and the Penal Code 2005 § 291/§ 292 for rape by having sexual intercourse with someone who was unable to resist this. All indictments concern documents to be carried out in connection with medical examinations in the period 2004 to 2022. With one exception, the examinations were carried out at the office where Arne Bye worked. A number of the investigations are filmed without the victim’s knowledge or consent. – It is an acknowledgment on my part regarding this that touching these areas has been inadequate.
