– We accept the district court’s verdict, says police attorney Hans Olav Røyr at the Agder police district. He will not give any further reasons for why the police are not appealing the doctor’s acquittal. Røyr filed a claim for 18 days in prison for the doctor after a botched operation on Svein Are Auestad in 2019. Omarchanov decided to operate on Svein Are Auestad himself before he had taken an X-ray. He was not an orthopedist. Photo: Privat Omarchanov is behind dozens of botched operations in Flekkefjord and Kristiansand. Sørlandet Hospital allowed him to work for eleven years as a senior doctor in orthopedics without being an orthopedist. All the other cases are outdated, according to the police, who have used the Health Personnel Act. It was the two lay judges who believed that Sørlandet Hospital had to take the main responsibility for the errors. Professional judges would judge Omarchanov. But what is the justification from the police? – I am not going to go into any further justification. This is based on an overall assessment, says Røyr. – Relieved and happy Defense attorney Carl-Henning Leknesund. Photo: Per-Kåre Sandbakk / news – My client is relieved and happy that the district court’s verdict will stand, says defense lawyer Carl-Henning Leknesund. Omarchanov did not appear at his own trial in Kristiansand. He lives and works in Germany. He has refused to be questioned by the police, and he also refused to sign the indictment. Leknesund says the doctor is satisfied with the outcome. – He is looking forward to being able to put this case behind him. – I don’t know what to say. Svein Are Auestad feels there is no justice in this case. Photo: Per-Kåre Sandbakk / news – I don’t know what to say. This is hugely disappointing, says Svein Are Auestad, who underwent a botched operation. His case is the only one that came to court. – I think of all the other people who have had the wrong operation. There is no justice in this. Auestad lives every day with severe pain after the hand operation. He can no longer work, and the nerve pain is taking over his body more and more. – This makes everything even more painful for us who have been injured. Even if the sentence would not be long, one would at least feel that he had to be held accountable.
