– He describes himself as excessively conscientious in his work. That’s what psychologist specialist Kåre Nonstad says about the former municipal superintendent and GP in Frosta. Arne Bye himself explained that he is afraid of overlooking potential illness during examinations of patients. – He seeks perfectionism, is preoccupied with control to avoid anxiety and seems pedantic in explanations and justifications, adds Nonstad. The indictment in the case against Arne Bye: On 17 September 2024, the indictment against the former municipal superintendent and GP was ready. The indictment deals with a total of 94 offended women. For all 94, the indictment is for violating the Penal Code 1902 § 193 and the Criminal Code 2005 § 295 for having obtained sexual relations by abusing his position as a doctor. In 87 of the cases, he is additionally prosecuted for a breach of the Penal Code 1902 § 192 first and second paragraphs and the Penal Code 2005 § 291/§ 292 for rape by having sexual relations with someone who was unable to resist this. All indictments concern documents to be carried out in connection with medical examinations in the period 2004 to 2022. With one exception, the examinations were carried out at the office where Arne Bye worked. A number of the investigations are filmed without the victim’s knowledge or consent. The psychological specialist says that it is uncertain whether the defendant has a personality disorder because he has worked for a long time in demanding work and had a family life. – We therefore saw a tentative, i.e. tentative, diagnosis of obsessive-compulsive personality disorder. But the forensic psychiatrists claim that the defendant has been under great pressure for a long time. – It can be an expression of a milder condition, adds Nonstad. Overlap with Asperger’s syndrome The psychologist told the court that obsessive-compulsive personality disorder overlaps with Asperger’s syndrome. – Lack of flexibility, special interests, social dysfunction, rule management and lack of mentalization are common to the diagnoses, says Nonstad. He pointed out that persisting with peculiar methods despite being pointed out instead of checking with others may be a common feature of both diagnoses. In his statement, the defendant explained how he used alternative equipment such as an inhaler, deodorant and a bottle during gynecological examinations. – I’m not going to use the term brilliantly, but I thought it was a smart idea, Bye said about the use of an inhaler in the abdomen in court on Wednesday. Nonstad says the defendant may also have what is called a sexual deviation. It can be valid if it concerns a sexual ignition against the gynecological examinations. But if that is how the defendant himself describes it, it is different. – Then it could be that his compulsive perfectionism has led to difficulties for him in his work without it being a matter of sexual deviations. Admits that applying drugs to the abdomen was not part of The former municipal superintendent and GP in Frosta is charged with having raped 87 women during gynecological examinations. In addition, he is accused of 94 cases of abusing his position as a doctor to obtain sexual intercourse. The defendant acknowledges three out of 87 rapes. He also admits 35 cases of abusing his position as a doctor in order to obtain sexual intercourse. – It is an acknowledgment on my part regarding this that touching these areas has been inadequate. That’s what the defendant says when asked by the prosecutor about touching the clitoris. In several cases, it has happened in connection with the application of anesthetics.
