So says the parents’ lawyer, Marius Mørner Staurset. He has barely had time to talk to his parents. Today, they received the message that the case will be processed again. In 2019, Martine’s nanny was sentenced to four years in prison in the Court of Appeal. The woman has always said that she did not hurt the girl. The re-admission commission writes that there is new evidence and circumstances which, combined with the other evidence that was presented to the court, give a reasonable possibility that the convicted person would have been acquitted, if the new evidence or circumstances had been known to the court when the case was sentenced. – Creates uncertainty about the case – What do you think as a lawyer for the girl’s parents? – It is a very heavy and tough case which is characterized by medical experts who stand against each other on very important points in the case. That makes it very challenging. He is also surprised by the commission’s decision. – The Court of Appeal had a thorough treatment and a thorough judgement, says Staurset. – Everyone wants correct court decisions. But when you sit with a judgment that you believe is correct, all the rematches create uncertainty and uneasiness about the case. This is tough for everyone involved, especially the parents, says Staurset. This was the second time the readmission commission dealt with the nanny’s case. Last time, it was rejected by the narrowest possible margin, three to two votes. Now a new Court of Appeal will hear the case. Re-admission commission Body that assesses whether a criminal case that has been legally decided by the courts must be re-processed by the court. The commission is independent of the courts and will thus contribute to greater legal certainty in Norway. The commission has five permanent members. The chairman, deputy chairman and one other member must have a law background. In 2022, the commission dealt with 242 cases. Of these, 44 were definitely reopened. If the case is reopened, the question of guilt and/or the sentencing must be tried again.
