– My client is satisfied with the verdict, and now we look forward to the appeal hearing in the autumn, says defense attorney Lerum to news. It was last summer that a one-year-old fell out of a window in Stavanger. The fall is said to have been almost four metres, and the child is said to have hit a car. A resident reportedly heard a bang from outside his home. When he got out, he saw that the rear window of his car was broken. When the car owner checked one of his surveillance cameras, he got a shock. The video showed that a child had fallen from a window and hit the rear window of the car. The man’s defender, Knut Lerum. Photo: Ole Andreas Bø / news Climbed onto the table while the father was on the toilet According to the judgment from the Sør-Rogaland District Court, the child climbed onto a living room table that was close to the window while the father was on the toilet. The child then managed, according to the father’s explanation, to open the window and then fall out of it. From the window down to the ground is approximately five metres, but the one-year-old hit the window of the car below the window, before it then fell to the ground. The father quickly got down and found the child, who looked relatively unharmed, according to the verdict. He examined the child, and is said to have found that it had no visible injuries, apart from a few scrapes on the back which were plastered. Waited to contact emergency room and hospital The man chose, seen in the light of the fact that everything seemed to have gone well, to wait before possibly contacting emergency room or hospital. According to the verdict, he was worried, both for the child and what those around him would say. He searched online for “child dropped from 2 floor”, without finding anything of concern. Eventually, when the neighbor saw the surveillance video on his mobile phone, he contacted the police, who arrived with an ambulance and took the child to the emergency room. By then, 7 hours had passed since the fall. Stavanger emergency room. According to the judgement, the child has also not suffered any injuries as a result of the fall. The court believes that the accused man made a conscious choice by failing to give the child the necessary health care, despite the fact that he was aware that his son had had a major fall of several meters from the window. – Satisfied with the verdict The court believes that the fall was so big and serious that, based on the circumstances, it could easily have caused serious damage to the child. And that the child was in a helpless state, as he could not report any pain. In the judgment, the court believes that the father, through his failure to provide the child with immediate and required health care, put his own interests ahead of the child’s urgent need for proper examination and treatment. He is therefore sentenced to six months’ suspended imprisonment. The prosecution believed that six months’ unconditional imprisonment was an appropriate punishment, and the State Attorney informed news that they had appealed the sentence. It is therefore not legally binding. – The ink was not dry in the district court before the State Attorney appealed to the Court of Appeal, says the father’s defender, Knut Lerum to news.
