Last summer, a 36-year-old man from Fredrikstad was sentenced to ten years in prison for attempted murder on the E6 in Sarpsborg. In March, the sentence was reduced to eight years in prison by the Court of Appeal. Now the Supreme Court has acquitted the 36-year-old of attempted murder. The Supreme Court believes the man was insane when he drove into another car at 180 kilometers per hour on the motorway. According to the verdict, the man was acutely paranoid psychotic when he carried out the attempted murder. The psychosis meant that the 36-year-old was unable to assess the situation and make rational choices. Therefore, he cannot be punished either, concludes the Supreme Court. The same was done by the district court and the court of appeal, which sentenced him to ten and eight years in prison respectively. – Despite his health condition, it is fair and reasonable to hold him criminally responsible, the judgment from the Court of Appeal states. – Borderline case – This is a borderline case, said the man’s defender Ole Petter Drevland to news in March. The 36-year-old himself has always claimed that he was too ill to be punished. He therefore appealed the case to the Supreme Court. – We believe that his state of mind and ability to function were of such a nature that he cannot be held criminally sane, Drevland said when the Court of Appeal’s verdict was announced. After driving past a number of cars at a very high speed, the man crashed into another car at 180 kilometers per hour. In the passenger seat sat his then wife. She was slightly injured, while the driver of the other car suffered serious head injuries.
