Four American organizations announced on Friday, May 9, having asked the Inter-American Human Rights Commission (CIDH) to intervene against the Salvador detention of hundreds of migrants expelled from the United States.

Invoking a law of 1798 on “foreign enemies”, hitherto used exclusively in wartime, the Trump administration expelled, without judgment, 252 Venezuelans to Salvador. Most are accused of belonging to the Gang Tren in Aragua, declared organization “terrorist” by Washington.

“Forced disappearances”

The American authorities did not explain in detail how they had determined belonging to the gang of these illegal migrants. Relatives of the expelled claim their innocence and consider their transfer to a high security prison in Salvador unfair.

A Federal Judge of Texas considered in early May that the use of the law on “foreign enemies” to expel immigrants was “Illicit”. Courts and courts of appeal as well as the Supreme Court also provisionally blocked the use of this law on the grounds that the expelled persons should be able to assert their rights.

The four organizations in question – the International Human Rights Clinic of the Faculty of Law of the University of Boston, the Center for Studies on Gender and Refugees, the World Council for Strategic Disputes and Robert F.
